자유무역지역의 지정 및 운영에 관한 법률 제40조(물품의 폐기)

① 세관장은 자유무역지역에 있는 물품 중 다음 각 호의 어느 하나에 해당하는 물품에 대하여는 화주 및 반입자와 그 위임을 받은 자(이하 "화주등"이라 한다)에게 국외 반출 또는 폐기를 명하거나 화주등에게 미리 통보한 후 직접 이를 폐기할 수 있다. 다만, 화주등에게 통보할 시간적 여유가 없는 특별한 사정이 있을 때에는 그 물품을 폐기한 후 지체 없이 화주등에게 통보하여야 한다.

② 세관장은 제1항에 따른 통보를 할 때에 화주등의 주소 또는 거소를 알 수 없거나 그 밖의 부득이한 사유로 통보를 할 수 없는 경우에는 대통령령으로 정하는 바에 따라 공고로써 통보를 갈음할 수 있다.

③ 제1항에 따라 화주등이 물품을 국외로 반출하거나 폐기한 경우 또는 세관장이 폐기한 경우 그 비용은 화주등이 부담한다.
