자유무역지역의 지정 및 운영에 관한 법률 제39조(입주기업체의 재고관리 상황의 조사 등)

① 세관장은 제38조에 따른 재고관리의 이행 여부를 확인하기 위하여 소속 공무원으로 하여금 입주기업체에 대하여 조사를 하게 할 수 있다. 이 경우 조사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여 주어야 한다.

② 세관장은 입주기업체에 대하여 제1항에 따른 조사에 필요한 회계장부, 원재료 및 제품의 관리대장, 그 밖에 필요한 자료의 제출을 요구할 수 있다.

③ 입주기업체는 정당한 사유 없이 제1항에 따른 조사를 거부ㆍ방해 또는 기피하거나 제2항에 따른 자료제출을 거부하여서는 아니 된다.

④ 세관장은 제1항에 따라 조사를 한 결과 외국물품등의 재고가 부족한 경우에는 대통령령으로 정하는 바에 따라 입주기업체로부터 그에 해당하는 관세등을 지체 없이 징수하여야 한다. 다만, 제38조제3항에 따른 분실신고를 한 물품이 자유무역지역에 있는 것이 확인되는 경우 또는 재해나 그 밖의 부득이한 사유로 물품이 멸실된 경우에는 그러하지 아니하다.

⑤ 관리권자는 자유무역지역의 효율적인 관리ㆍ운영을 위하여 필요한 경우에는 대통령령으로 정하는 바에 따라 관세청장에게 입주기업체의 물품 반입ㆍ반출실적에 대한 자료의 제공을 요청할 수 있다. <신설 2016.1.27>
