자연환경보전법 제33조(타인토지에의 출입 등)

①환경부장관 또는 지방자치단체의 장은 제30조의 자연환경조사 또는 제31조에 따른 정밀ㆍ보완조사를 위하여 필요한 경우에는 소속 공무원 또는 조사원으로 하여금 타인의 토지에 출입하여 조사하거나 그 토지의 나무ㆍ흙ㆍ돌 그 밖의 장애물을 변경 또는 제거하게 할 수 있다. <개정 2020.5.26>

②제1항에 따라 타인의 토지에 출입하고자 하는 사람은 출입할 날의 3일 전까지 그 토지의 소유자ㆍ점유자 또는 관리인에게 그 뜻을 통지하여야 한다. <개정 2020.5.26>

③제1항에 따라 장애물을 변경 또는 제거하고자 하는 사람은 그 소유자ㆍ점유자 또는 관리인의 동의를 얻어야 한다. 다만, 장애물의 소유자ㆍ점유자 또는 관리인이 현장에 없거나 주소를 알 수 없는 경우에는 해당 지역을 관할하는 읍ㆍ면ㆍ동의 게시판에 게시하거나 일간신문에 공고하여야 한다. 이 경우 14일이 지난 때에는 동의를 얻은 것으로 본다. <개정 2020.5.26>

④토지의 소유자ㆍ점유자 또는 관리인은 정당한 사유없이 제1항에 따른 조사행위를 거부ㆍ방해 또는 기피하지 못한다. <개정 2020.5.26>

⑤제1항에 따라 타인의 토지에 출입하고자 하는 사람은 환경부령으로 정하는 바에 따라 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다. <개정 2020.5.26>
