자연유산의 보존 및 활용에 관한 법률 제28조(정기조사)

① 국가유산청장은 천연기념물 또는 명승의 보존ㆍ관리 및 활용 현황 등에 관하여 5년마다 조사하여야 한다. <개정 2024.2.13>

② 국가유산청장은 제1항에 따른 정기조사 결과 해당 천연기념물 또는 명승의 보존ㆍ관리 및 활용에 뚜렷한 변화가 있는 경우에는 그 소속 공무원에게 해당 천연기념물 또는 명승에 대하여 추가로 조사하게 할 수 있다. <개정 2024.2.13>

③ 국가유산청장은 제1항 및 제2항에 따른 조사를 시행하는 경우에는 조사 개시 3일 전까지 해당 천연기념물 또는 명승의 소유자등에게 조사 시기, 기간, 방법 등을 알려야 한다. 다만, 긴급한 경우에는 사후에 그 취지를 알릴 수 있다. <개정 2024.2.13>

④ 누구든지 제1항 및 제2항에 따른 조사를 방해하여서는 아니 된다.

⑤ 제1항 또는 제2항에 따른 조사를 하는 공무원은 소유자등에게 천연기념물 또는 명승의 공개, 현황자료의 제출, 소재장소 출입 등 조사에 필요한 범위에서 협조를 요구할 수 있으며, 해당 천연기념물 또는 명승을 훼손하지 아니하는 범위에서 측량, 발굴, 장애물의 제거, 표본채취, 그 밖에 조사에 필요한 행위를 할 수 있다. 다만, 해가 뜨기 전이나 해가 진 후에는 소유자등의 동의를 받아야 한다.

⑥ 국가유산청장은 제1항 및 제2항에 따른 조사의 전부 또는 일부를 지방자치단체에 위임하거나 전문기관 또는 단체에 위탁할 수 있다. 이 경우 국가유산청장은 조사에 필요한 비용의 전부 또는 일부를 지원할 수 있다. <개정 2024.2.13>

⑦ 제1항 및 제2항에 따른 조사의 구체적인 시기와 방법, 절차 등과 제6항에 따른 조사의 위임ㆍ위탁에 필요한 사항은 대통령령으로 정한다.
