자동차 등 특정동산 저당법 제8조(양도명령에 따른 환가방법의 특례)

① 담보목적물(항공기 및 경량항공기를 제외한다. 이하 이 조에서 같다)에 대한 저당권의 실행을 위한 경매절차에서 법원은 상당하다고 인정하는 때에는 저당권자의 매수신청에 따라 경매 또는 입찰에 의하지 아니하고 그 저당권자에게 압류된 담보목적물의 매각을 허가하는 양도명령의 방법으로 환가할 수 있다. <개정 2015.5.18>

② 제1항에 따른 양도명령의 절차에 관하여 필요한 사항은 대법원규칙으로 정한다.
