이 법은 건설기계, 「선박등기법」이 적용되지 아니하는 선박, 자동차, 항공기 등 등록의 대상이 되는 동산(動産)의 저당권에 관한 사항을 정하여 그 담보제공에 따른 자금 융통을 쉽게 하고, 저당권자ㆍ저당권설정자 및 소유자의 권익을 균형 있게 보호함을 목적으로 한다.
