입목에 관한 법률 제18조(소유권보존등기)

① 등기관은 이미 등기되어 있는 토지에 부착된 수목에 대하여 소유권보존의 등기를 하는 경우에 토지의 등기기록에 토지 또는 지상권을 목적으로 하는 저당권의 등기가 있을 때에는 입목등기기록에 그 등기를 전사(轉寫)하여야 한다. 다만, 그 등기에 저당권이 수목에 미치지 아니한다는 뜻이 기록되어 있을 때에는 예외로 한다. <개정 2012.2.10>

② 제1항에 따라 저당권의 전사를 할 때에는 그 저당권의 등기에 관하여 이미 공동담보목록이 있는 경우를 제외하고 등기관은 공동담보목록을 작성하여야 한다.
