인터넷주소자원에 관한 법률 제18조의2(판단기준)

① 피신청인이 등록한 인터넷주소의 사용이 다음 각 호의 어느 하나에 해당하는 경우에는 조정부는 피신청인의 인터넷주소를 신청인에게 이전하도록 하거나 말소하는 조정결정을 할 수 있다.

(1) Where웨어 the^ð더 use유스 of어^v브 the^ð디 Internet인터넷 address애드^r레스 registered^r레지스터드 by바이 the^ð더 respondent^r리스판던트 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following,^f팔로잉 the^ð더 mediation미디에이션 panel패늘 may메이 make메이크 a어 mediation미디에이션 decision디시전 to투 have해^v브 the^ð더 respondent's^r리스판던츠 Internet인터넷 address애드^r레스 transferred트^r랜스^f퍼드 to투 the^ð디 applicant애플리컨트 or오 cancelled:캔슬드

② 피신청인의 인터넷주소의 등록ㆍ보유 또는 사용이 정당한 권원이 있는 자의 인터넷주소의 등록 또는 사용을 방해하거나 성명, 명칭, 표장 또는 상호 등에 대하여 정당한 권한이 있는 자에게 판매ㆍ대여하려는 등 부당한 이득을 얻으려는 목적으로 행하여진 경우에도 조정부는 제1항과 같은 결정을 할 수 있다.

③ 제1항 및 제2항에도 불구하고 피신청인의 인터넷주소가 피신청인이 정당한 권원을 가지고 있는 성명, 명칭, 표장 또는 상호와 동일하거나 그 밖에 피신청인이 인터넷주소의 등록이나 사용에 정당한 권리나 이익을 가지고 있는 경우에는 조정부는 신청을 기각할 수 있다.
