인감증명법 제12조(인감증명서의 발급)

① 인감증명서를 발급받으려면 본인 또는 그 대리인이 대통령령으로 정하는 바에 따라 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장(자치구가 아닌 구의 구청장을 포함한다)이나 읍장ㆍ면장ㆍ동장 또는 출장소장(이하 "인감증명서발급기관"이라 한다)에게 신청하여야 한다. 다만, 미성년자는 법정대리인의 동의를 받아 신청하여야 하고, 피한정후견인은 인감증명서의 용도가 한정후견인의 동의가 필요한 사항인 경우에는 한정후견인의 동의를 받아 신청하여야 하며, 피성년후견인은 성년후견인이 신청하여야 한다.

② 제1항에 따라 인감증명서의 발급신청을 받은 인감증명서발급기관은 전산정보처리조직을 이용하여 대통령령으로 정하는 바에 따라 인감증명서를 발급할 수 있다.

③ 대리인이 인감증명서를 발급받으려는 경우에는 대통령령으로 정하는 바에 따라 자신의 무인(拇印)을 하여야 한다.
