①법 제3조제6항의 규정에 의하여 인감을 신고하려는 자는 법 제7조제1항의 규정에 의하여 신고인 본인이 소관증명청을 방문하여 신분증과 인감에 사용될 인장을 제출하고, 다음 각호의 사항을 구술로 신고하여야 한다. 이 경우 인감을 신고하려는 자가 피성년후견인인 경우에는 성년후견인이 방문하여 신고하여야 하고, 미성년자인 경우에는 미성년자가 법정대리인과 함께 방문하여 신고하여야 하며, 피한정후견인인 경우에는 피한정후견인이 한정후견인과 함께 방문하여 신고하여야 한다. <개정 2005.1.15, 2007.12.31, 2015.1.20, 2016.7.5>

② 제1항 후단에도 불구하고 인감을 신고하려는 자가 피한정후견인인 경우 「후견등기에 관한 법률」 제15조제1항에 따른 등기사항증명서(이하 "등기사항증명서"라 한다)에 한정후견인이 인감신고에 관한 대리권을 행사할 수 있다고 기재된 경우에는 한정후견인이 혼자 방문하여 피한정후견인의 인감을 신고할 수 있다. <신설 2016.7.5>

⑤ 제3항 또는 제4항에 따른 확인을 마친 증명청은 신고인이 보는 앞에서 인감대장의 해당란에 필요한 사항을 적은 후 인감란에 인장을 날인하여야 한다. 이 경우 증명청은 인감대장의 비고란에 "구술신고"라고 적고, 신고인에게 관계사항을 확인하게 한 후 신고인의 엄지손가락 지문(엄지손가락 지문이 분명하지 아니할 경우에는 다른 손가락의 지문을 말한다. 이하 "무인(拇印)"이라 한다)을 받아야 하며, 신고인이 미성년자인 경우에는 법정대리인의 무인을 받아야 하고, 신고인이 피한정후견인인 경우에는 한정후견인의 무인을 받아야 한다. <신설 2013.4.22, 2016.7.5>
