의무경찰대 설치 및 운영에 관한 법률 시행령 제43조(위원회의 결정)

①소청사건의 결정은 재적위원 과반수의 합의에 의하되, 의견이 분립될 경우에는 재적위원 과반수에 달하기까지 소청인에게 가장 불리한 의견에 순차 유리한 의견을 가하여 그 가장 유리한 의견을 합의된 의견으로 본다.

②위원회의 위원은 친족의 소청사건에 관여하지 못한다.

③위원회의 결정은 그 이유를 명시한 결정서로 하여야 한다.

④위원회가 소청사건을 심사할 경우에는 원징계처분에서 과한 징계보다 중한 징계를 과하는 결정을 하여서는 아니된다.
