유통산업발전법 제44조의2(대규모점포등의 관리현황 점검ㆍ감독 등)

① 산업통상부장관 또는 특별자치시장ㆍ시장ㆍ군수ㆍ구청장은 대규모점포등관리자의 업무집행 및 비용의 징수ㆍ관리 등에 관하여 확인이 필요하다고 인정될 때에는 대규모점포등관리자에 대하여 그 업무에 관한 사항을 보고하게 하거나 자료를 제출하게 할 수 있으며, 관계 공무원에게 사업장 등을 출입하여 관계 서류 등을 검사하게 할 수 있다. <개정 2025.10.1>

② 제1항에 따른 검사를 하려는 공무원은 검사 3일 전까지 그 일시ㆍ목적 및 내용을 검사대상자에게 통지하여야 한다. 다만, 긴급히 검사하여야 하거나 사전에 알리면 증거인멸 등으로 검사목적을 달성할 수 없다고 인정하는 경우에는 그러하지 아니하다.

③ 제1항에 따라 출입ㆍ검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여 주어야 한다.
