Enforcement Decree of the Early Childhood Education Act, Article 9 (Applications for Authorization to Establish Private Kindergartens, etc.)
① 법 제8조제2항에 따라 사립유치원의 설립인가를 받으려는 자는 교육부령으로 정하는 바에 따라 목적, 명칭, 위치 및 개원 예정 연월일 등을 기재한 학교설립 인가신청서에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 교육감에게 신청하여야 한다. <개정 2015.11.30>
(1) A person who intends to obtain authorization to establish a private kindergarten under Article 8 (2) of the Act shall apply to the superintendent of education, as prescribed by Ordinance of the Ministry of Education, with an application for authorization to establish a school stating the purpose, name, location, and scheduled date of opening, etc., with the following documents (including electronic documents) attached:
1. 법 제10조에 따른 유치원규칙(이하 "유치원규칙"이라 한다)
1. The kindergarten rules under Article 10 of the Act (hereinafter referred to as the "kindergarten rules");
2. 교지ㆍ실습지의 지적도
2. A cadastral map of the school site and practice site;
3. 교사(체육장을 포함한다)의 평면도
3. A floor plan of the school building (including the sports ground);
4. 설립자가 법인인 경우에는 등기 및 출연금에 관한 서류
4. Where the founder is a corporation, documents on registration and endowment;
5. 설립자가 사인(私人)인 경우에는 경비의 지급 및 변제 능력에 관한 서류
5. Where the founder is a private individual, documents on the ability to pay and repay expenses;
6. 해당 유치원의 장으로 임용될 사람의 경우에는 다음 각 목의 서류

가. 자격증명에 필요한 서류

나. 성범죄 경력 조회동의서
(b) A consent form for inquiry into sex crime records;

7. 시설 및 설비 관련 서류 등 그 밖에 교육부령으로 정하는 서류
7. Other documents prescribed by Ordinance of the Ministry of Education, such as documents on facilities and equipment.
② 법 제8조제4항에 따라 유치원의 폐쇄인가를 받으려는 사립유치원의 설립ㆍ경영자는 교육부령으로 정하는 바에 따라 폐쇄사유, 폐쇄 예정연월일을 기재한 학교폐쇄 인가신청서에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 교육감에게 신청해야 한다. <개정 2019.8.6>
(2) The founder or operator of a private kindergarten who intends to obtain authorization for closure of the kindergarten under Article 8 (4) of the Act shall apply to the superintendent of education, as prescribed by Ordinance of the Ministry of Education, with an application for authorization to close a school stating the reason for closure and the scheduled date of closure, with the following documents (including electronic documents) attached:
1. 해당 유치원의 유아에 대한 전원(轉園)조치 계획을 포함한 유아 지원 계획서
1. A support plan for young children, including a plan for transferring the kindergarten's young children to other kindergartens;
1의2. 해당 유치원의 설비처리 계획서
1-2. A plan for disposing of the kindergarten's equipment;
2. 재산처리에 관한 사항 등 그 밖에 교육부령으로 정하는 서류
2. Other documents prescribed by Ordinance of the Ministry of Education, such as matters concerning disposal of property.
③ 교육감은 법 제8조제4항에 따라 유치원의 폐쇄를 인가하려는 경우에는 다음 각 호의 사항을 고려해야 한다. <신설 2019.8.6>
(3) Where the superintendent of education intends to authorize the closure of a kindergarten under Article 8 (4) of the Act, the superintendent shall consider the following:
1. 유치원 폐쇄 예정연월일의 적절성
1. The appropriateness of the scheduled date of closure of the kindergarten;
2. 유아 지원 계획의 적절성
2. The appropriateness of the support plan for young children;
3. 유치원 폐쇄에 관한 해당 유치원 학부모의 의견
3. The opinions of the parents of the kindergarten on its closure;
4. 그 밖에 유아의 학습권 보호에 필요한 사항
4. Other matters necessary to protect the young children's right to learn.
④ 제3항에 따른 고려 사항의 세부 기준과 그 밖에 유치원 폐쇄인가에 필요한 사항은 교육감이 정한다. <신설 2019.8.6>
(4) Detailed standards for the matters to be considered under paragraph (3) and other matters necessary for authorizing the closure of kindergartens shall be determined by the superintendent of education.
⑤ 교육감은 법 제8조제4항에 따라 유치원의 폐쇄를 인가하는 경우에는 해당 유치원의 유아에 대한 전원조치가 이루어지는지를 확인해야 한다. <신설 2019.8.6>
(5) Where the superintendent of education authorizes the closure of a kindergarten under Article 8 (4) of the Act, the superintendent shall confirm whether the kindergarten's young children are being transferred to other kindergartens.
⑥ 법 제8조제4항에서 "대통령령으로 정하는 중요사항"이란 다음 각 호의 사항을 말한다. <개정 2015.11.30, 2019.8.6>
(6) The term "important matters prescribed by Presidential Decree" in Article 8 (4) of the Act means the following:
1. 유치원의 설립ㆍ경영자
1. The founder or operator of the kindergarten;
2. 목적
2. The purpose;
3. 명칭
3. The name;
4. 위치
4. The location;
5. 유치원규칙의 기재사항 중 제10조제1항제2호ㆍ제6호ㆍ제8호 또는 제9호

⑦ 법 제8조제4항에 따라 변경인가를 받으려는 사립유치원의 설립ㆍ경영자는 교육부령으로 정하는 바에 따라 변경사유, 변경사항 및 변경 연월일을 기재한 학교변경 인가신청서에 변경사항에 따른 관련 서류(전자문서를 포함한다)를 첨부하여 교육감에게 신청하여야 한다. <개정 2019.8.6>
(7) The founder or operator of a private kindergarten who intends to obtain authorization for change under Article 8 (4) of the Act shall apply to the superintendent of education, as prescribed by Ordinance of the Ministry of Education, with an application for authorization to change a school stating the reason for the change, the matters changed, and the date of the change, with related documents (including electronic documents) on the matters changed attached.
⑧ 교육감은 법 제8조제4항에 따른 유치원의 폐쇄인가 또는 변경인가의 신청을 받은 날부터 다음 각 호의 구분에 따른 기간 이내에 인가 여부 또는 처리 지연 사유를 신청인에게 통지하여야 한다. <신설 2018.3.13, 2019.8.6, 2021.7.13>
(8) Within the following periods from the date of receiving an application for authorization of closure or change of a kindergarten under Article 8 (4) of the Act, the superintendent of education shall notify the applicant of whether authorization is granted or of the reason for delay in handling, as classified:
1. 유치원의 폐쇄: 60일
1. Closure of a kindergarten: 60 days;
2. 유치원의 위치 변경: 30일
2. Change of the location of a kindergarten: 30 days;
3. 유치원의 설립ㆍ경영자 변경: 15일
3. Change of the founder or operator of a kindergarten: 15 days.
