위치정보의 보호 및 이용 등에 관한 법률 시행령 제26조의2(개인위치정보의 파기 등)

① 법 제23조제1항 본문 및 제24조제4항에 따른 개인위치정보 및 위치정보 수집ㆍ이용ㆍ제공사실 확인자료의 파기에 관하여는 제8조의2를 준용한다. 이 경우 "위치정보 수집사실 확인자료"는 "위치정보 수집ㆍ이용ㆍ제공사실 확인자료"로 본다.

② 법 제23조제1항 단서에서 "대통령령으로 정하는 정당한 사유"란 개인위치정보주체가 자신의 개인위치정보의 보유에 관하여 별도로 동의한 경우를 말한다.

③ 법 제23조제1항 단서에 따라 개인위치정보를 보유할 수 있는 기간은 개인위치정보주체가 동의한 때부터 최대 1년까지로 한다.

④ 방송미디어통신위원회가 법 제23조제3항에 따라 소속 공무원으로 하여금 개인위치정보의 파기실태를 점검하게 하려는 경우 점검 절차 및 방법에 관하여는 제21조를 준용한다. <개정 2025.10.1>
