위생용품 관리법 제19조(폐쇄조치 등)

① 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 영업자가 제17조제1항에 따른 영업소 폐쇄명령을 받고도 계속하여 영업을 하는 경우에는 해당 영업소를 폐쇄하기 위하여 관계 공무원에게 다음 각 호의 조치를 하게 할 수 있다.

② 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항제2호 또는 제3호에 따른 조치를 한 후에 다음 각 호의 어느 하나에 해당하는 경우에는 게시한 안내문 등을 제거하거나 봉인을 해제할 수 있다.

③ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 조치를 하려면 해당 영업자 또는 그 대리인에게 문서로 미리 알려야 한다. 다만, 국민의 건강을 심각하게 해칠 우려가 있는 등 급박한 사유가 있으면 그러하지 아니하다.

④ 제1항에 따라 영업표지물의 제거ㆍ안내문 등의 게시ㆍ봉인 등의 조치를 하는 관계 공무원은 그 권한을 표시하는 증표 및 조사기간, 조사범위, 조사담당자, 관계 법령 등 대통령령으로 정하는 사항이 기재된 서류를 지니고 이를 관계인에게 보여 주어야 한다.
