원자력안전법 제28조(발전용원자로 및 관계시설의 해체)

① 발전용원자로운영자가 발전용원자로 및 관계시설을 해체하려는 때에는 대통령령으로 정하는 바에 따라 위원회의 승인을 받아야 한다. 승인받은 사항을 변경하려는 때에도 또한 같다. 다만, 총리령으로 정하는 경미한 사항을 변경하려는 때에는 이를 위원회에 신고하여야 한다.

② 제1항의 승인을 받으려는 자는 승인신청서에 발전용원자로 및 관계시설의 해체계획서와 총리령으로 정하는 서류를 첨부하여 위원회에 제출하여야 한다.

③ 발전용원자로운영자는 발전용원자로 및 관계시설의 해체상황을 총리령으로 정하는 바에 따라 위원회에 보고하여야 한다. 이 경우 위원회는 발전용원자로 및 관계시설의 해체상황을 확인ㆍ점검하여야 한다.

④ 발전용원자로운영자가 발전용원자로 및 관계시설의 해체를 완료한 때에는 총리령으로 정하는 바에 따라 위원회에 보고하여야 한다.

⑤ 제4항에 따라 보고하려는 자는 해체완료보고서와 총리령으로 정하는 서류를 첨부하여 위원회에 제출하여야 한다.

⑥ 위원회는 발전용원자로 및 관계시설의 해체가 완료된 때에는 총리령으로 정하는 바에 따라 검사를 하여야 한다.

(6) When웬 decommissioning디커미셔닝 of어^v브 the^ð더 power파워 reactor^r리액터 and앤드 related^r릴레이티드 facilities^f퍼실러티즈 has해즈 been빈 completed,컴플리티드 the^ð더 Commission커미션 shall섈 conduct칸덕트 an앤 inspection,인스펙션 as애즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Prime프^r라임 Minister.미너스터

⑦ 위원회는 제3항에 따른 확인ㆍ점검 결과 또는 제6항에 따른 검사 결과 발전용원자로운영자가 해체계획서에 따라 이행하지 아니하거나 제5항에 따른 해체완료보고서에 기재된 내용과 일치하지 아니하면 그 시정 또는 보완을 명할 수 있다.

⑧ 위원회는 제6항에 따른 검사를 완료한 때에는 제20조제1항에 따른 발전용원자로 및 관계시설의 운영허가의 종료를 해당 발전용원자로운영자에게 서면으로 통지하여야 한다.

⑨ 위원회는 발전용원자로운영자에게 제8항에 따른 통지를 할 때에는 방사선에 의한 재해의 방지와 공공의 안전을 위하여 필요한 경우 발전용원자로 및 관계시설의 해체 완료 후 부지의 재이용에 관하여 조건을 붙일 수 있다.

⑩ 위원회는 제1항 단서에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <신설 2022.6.10>
