Enforcement Decree of the Nuclear Safety Act, Article 156-2 (Method and Timing of Payment of the Charge, etc.)
① 위원회는 부담금을 징수하려면 그 금액과 함께 산출내용, 납부기한 및 납부장소를 명시하여 원자력관계사업자등에게 고지하여야 한다.
(1) To collect the charge, the Commission shall notify nuclear business operators, etc. of the amount together with details of calculation, payment deadline, and place of payment.
② 원자력관계사업자등은 제1항에 따라 부담금 납부를 고지받은 날부터 30일 이내에 부담금을 납부해야 한다. <개정 2025.12.23>
(2) Nuclear business operators, etc. shall pay the charge within 30 days from the date of being notified of payment of the charge under paragraph (1).
③ 위원회는 원자력관계사업자등이 부담금 분할납부를 신청하는 경우 위원회가 정하여 고시하는 바에 따라 부담금을 나누어 내게 할 수 있다. <신설 2025.12.23>
(3) The Commission may allow the charge to be paid in installments, as determined and publicly notified by the Commission, where nuclear business operators, etc. apply for installment payment of the charge.
④ 제2항 및 제3항에도 불구하고 다음 각 호에 해당하는 업무에 대한 부담금은 해당 호에서 정한 시기에 일시납부해야 한다. <개정 2025.12.23>
(4) Notwithstanding paragraphs (2) and (3), the charge for the following work shall be paid in a lump sum at the time determined in the relevant subparagraph:
1. 제156조제2항제2호에 따른 업무에 대한 부담금: 다음 각 목에서 정한 시기. 다만, 법 제47조제1항, 제56조제1항 본문 및 제80조제1항에 따른 검사(정기검사로 한정한다)의 경우에는 제2항에 따른다.
1. The charge for work under Article 156 (2) 2: the time determined in the following items: Provided, That for inspections (limited to periodic inspections) under Articles 47 (1), 56 (1) (main clause), and 80 (1) of the Act, paragraph (2) applies:
가. 법 제45조제1항 및 제53조제1항에 따른 허가: 허가에 관련된 안전성 심사 전까지
(a) Permits under Articles 45 (1) and 53 (1) of the Act: before the safety review related to the permit;
나. 법 제45조제1항 단서, 제52조제1항, 제53조제1항 단서, 같은 조 제2항, 제54조제2항, 제60조제1항 단서, 제71조제1항 및 제2항, 제76조제1항 단서, 제77조의2제1항 단서, 제78조제2항 및 제95조제1항에 따른 신고: 신고의 접수에 따른 처리 전까지
(b) Reports under the proviso of Article 45 (1), Article 52 (1), the proviso of Article 53 (1), paragraph (2) of the same Article, Article 54 (2), the proviso of Article 60 (1), Article 71 (1) and (2), the proviso of Article 76 (1), the proviso of Article 77-2 (1), Article 78 (2), and Article 95 (1) of the Act: before processing upon receipt of the report;
다. 법 제47조제1항, 제56조제1항 본문, 제61조제1항 본문, 제75조제1항, 제77조제1항 본문, 제77조의3제1항 및 제80조제1항에 따른 검사: 검사 전까지
(c) Inspections under Articles 47 (1), 56 (1) (main clause), 61 (1) (main clause), 75 (1), 77 (1) (main clause), 77-3 (1), and 80 (1) of the Act: before the inspection;
라. 법 제53조의2제1항 및 이 영 제107조제7항에 따른 사전검토: 사전검토 전까지
(d) Preliminary reviews under Article 53-2 (1) of the Act and Article 107 (7) of this Decree: before the preliminary review;
마. 법 제54조제1항 및 제78조제1항에 따른 등록: 등록에 관련된 안전성 심사 전까지
(e) Registration under Articles 54 (1) and 78 (1) of the Act: before the safety review related to the registration; and
바. 법 제60조제1항, 제76조제1항 및 제77조의2제1항에 따른 승인: 승인에 관련된 안전성 심사 전까지
(f) Approvals under Articles 60 (1), 76 (1), and 77-2 (1) of the Act: before the safety review related to the approval;
2. 제156조제2항제3호에 따른 업무에 대한 부담금: 다음 연도 4월 30일까지
2. The charge for work under Article 156 (2) 3: by April 30 of the following year;
3. 제156조제2항제5호에 따른 업무에 대한 부담금: 다음 각 목의 어느 하나 중에 원자력관계사업자등이 선택한 시기
3. The charge for work under Article 156 (2) 5: at the time selected by the nuclear business operator, etc. from among the following:
가. 교육 신청 시
(a) When applying for education; and
나. 보수교육 실시 연도 6월 30일까지(교육시작일이 7월 1일 이후인 경우에는 해당 연도 12월 31일까지)
(b) By June 30 of the year of refresher education (by December 31 of the relevant year where the education start date is on or after July 1); and
4. 제156조제2항제6호에 따른 업무에 대한 부담금: 수출입 신고 시. 다만, 전년도 기준 수출입 신고 건수가 월평균 5회 이상인 경우에는 월별로 합산하여 다음 달 5일까지 한 번에 납부할 수 있다.
4. The charge for work under Article 156 (2) 6: at the time of reporting export or import: Provided, That where the number of export and import reports for the previous year averaged five or more per month, the charge may be paid in one lump sum by the 5th of the following month by aggregating monthly.
⑤ 부담금은 현금, 신용카드 또는 직불카드 등으로 납부할 수 있다. <개정 2025.12.23>
(5) The charge may be paid in cash, by credit card, or by debit card, etc.
⑥ 위원회는 원자력관계사업자등이 납부한 부담금이 해당 업무의 변경ㆍ취소 등의 사유로 금액 차이가 발생한 경우에는 위원회가 정하여 고시하는 바에 따라 부담금을 정산하여 추가로 징수하거나 환급하여야 한다. <개정 2025.12.23>
