Enforcement Decree of the Act on Physical Protection and Radiological Emergency of Nuclear Facilities, etc., Article 7 (Threat Assessment and Establishment of the Physical Protection System)
① 법 제4조제1항에 따라 「원자력안전위원회의 설치 및 운영에 관한 법률」 제3조에 따른 원자력안전위원회(이하 "원자력안전위원회"라 한다)는 법 제3조제1항에 따른 물리적방호시책을 이행하기 위하여 3년마다 다음 각 호의 사항을 고려하여 원자력시설등에 대한 위협을 평가하고 물리적방호체제 설계ㆍ평가의 기준이 되는 위협(이하 "설계기준위협"이라 한다)을 설정하여야 한다. 다만, 물리적방호 관련 사고가 발생하거나 발생할 우려가 있다고 판단되는 경우에는 수시로 위협을 평가하고 설계기준위협을 설정할 수 있다. <개정 2013.12.24, 2014.11.19>
(1) Pursuant to Article 4 (1) of the Act, in order to implement the physical protection policy under Article 3 (1) of the Act, the Nuclear Safety and Security Commission under Article 3 of the Act on the Establishment and Operation of the Nuclear Safety and Security Commission (hereinafter referred to as the "Nuclear Safety and Security Commission") shall assess threats to nuclear facilities, etc. every 3 years, taking the following matters into account, and shall establish the threat that serves as the standard for designing and evaluating the physical protection system (hereinafter referred to as the "design basis threat"). However, where an accident related to physical protection has occurred or is judged likely to occur, threats may be assessed and the design basis threat established at any time:

(2) The Nuclear Safety and Security Commission shall establish the physical protection system for nuclear facilities, etc., reflecting the design basis threat established under paragraph (1).
③ 원자력안전위원회는 제1항에 따른 위협평가를 효율적으로 하기 위하여 관계 중앙행정기관의 장에게 협조를 요청할 수 있다. 이 경우 전자적 침해행위의 방지 및 원자력시설 컴퓨터 및 정보시스템의 보안과 관련한 사항에 대해서는 국가정보원장에게 우선적으로 협조를 요청하여야 한다. <신설 2013.12.24, 2016.5.31>
(3) The Nuclear Safety and Security Commission may request cooperation from the heads of relevant central administrative agencies in order to conduct the threat assessment under paragraph (1) efficiently. In such cases, regarding matters related to prevention of electronic intrusion and security of computers and information systems of nuclear facilities, cooperation shall be requested first from the Director of the National Intelligence Service.
④법 제4조제3항제4호에서 "대통령령으로 정하는 공공기관, 공공단체 및 사회단체"란 다음 각 호의 기관 및 단체(이하 "지정기관"이라 한다)를 말한다. <개정 2005.11.11, 2007.3.16, 2008.2.29, 2011.1.28, 2011.10.25, 2013.9.17, 2013.12.24, 2014.11.19, 2017.7.26, 2020.12.31, 2021.12.23>
(4) "Public institutions, public bodies, and social organizations prescribed by Presidential Decree" in Article 4 (3) 4 of the Act means the following institutions and organizations (hereinafter referred to as "designated institutions"):

9. 「한국원자력안전기술원법」에 의한 한국원자력안전기술원(이하 "한국원자력안전기술원"이라 한다)
9. The Korea Institute of Nuclear Safety under the Korea Institute of Nuclear Safety Act (hereinafter referred to as the "Korea Institute of Nuclear Safety")

(5) "Necessary measures prescribed by Presidential Decree" in the part preceding the subparagraphs of Article 4 (3) of the Act means the following measures:
1. 원자력시설등에 대한 위협에 효과적으로 대처하기 위한 물리적방호관련 시설ㆍ장비의 설치ㆍ운영관리(원자력사업자에 한한다)
1. Installation, operation, and management of physical protection-related facilities and equipment to effectively cope with threats to nuclear facilities, etc. (limited to nuclear business operators)
2. 원자력시설등에 대한 위협에 효과적으로 대처하기 위한 물리적방호관련 조직 및 인력의 운영(원자력사업자에 한한다)
