Distant Water Industry Development Act, Article 2 (Definitions)

이 법에서 사용하는 용어의 뜻은 다음과 같다. <개정 2013.7.30, 2015.1.6, 2020.2.18, 2023.10.24, 2026.3.17>

2. "원양어업"이란 대한민국국민이 해외수역에서 단독 또는 외국인과 합작(대한민국국민이 납입한 자본금 또는 보유한 의결권 등이 대통령령으로 정하는 기준 이상인 경우로 한정한다. 이하 같다)으로 수산동식물을 포획ㆍ채취하는 사업을 말한다.

3. "원양어업관련사업"이란 대한민국국민이 단독 또는 외국인과 합작으로 원양어업에서 생산된 수산물과 해외에서 대통령령으로 정하는 방법으로 투자하여 생산한 수산물을 운반ㆍ가공ㆍ유통ㆍ판매 등을 하는 사업(양식 및 이에 부대되는 사업을 포함한다)을 말한다.

4. "원양산업자"란 제2호에 따른 원양어업을 영위하는 자(이하 "원양어업자"라 한다)와 제3호에 따른 원양어업관련사업을 영위하는 자(이하 "원양어업관련사업자"라 한다)를 말한다.

5. "원양산업종사자"란 원양어업자에게 고용되어 원양어업에 종사하는 자(이하 "원양어업종사자"라 한다)와 원양어업관련사업자에게 고용되어 원양어업관련사업에 종사하는 자를 말한다.

6. "조업활동"이란 원양어업이나 원양어업에 관련된 탐색ㆍ집어(集魚), 어획물의 보관ㆍ저장ㆍ가공, 어획물 또는 그 제품의 운반(이하 "조업"이라 한다) 및 선박에 필요한 물건의 보급 등에 관한 행위를 말한다.

7. "국제수산기구"란 조약이나 국제적 협약ㆍ협정 등(이하 "국제법"이라 한다)에 따라 설립된 국제기구나 지역수산관리기구를 말한다.

8. "보존관리조치"란 국제법의 관련 규정에 따라 채택되고 적용된 하나 이상의 해양수산자원 종(種)의 보존 또는 관리를 위한 조치를 말한다.

9. "기국"(旗國)이란 어선 등의 국적을 알리기 위하여 게양하는 국기가 나타내는 국가를 말한다.

10. "해외수역"이란 동해ㆍ서해 및 동중국해와 북위 25도선 이북(以北), 동경 140도선 이서(以西)의 태평양해역을 제외한 해역을 말한다.

11. "옵서버"란 국제적 조업기준 준수 여부를 감시ㆍ감독하거나 과학적 조사를 위하여 승선(乘船)활동을 하는 자로서 해당 국가 또는 국제수산기구에서 지정하거나 선발한 자를 말한다.

나. 국제수산기구의 가입국 선박이 해당 국제수산기구의 법적 구속력이 있는 보존관리조치 또는 관련 국제법의 규정을 위반하여 행하는 어업활동

가. 한 국가의 관할 수역에서 조업을 한 경우로서 해당 국가의 국내법규를 위반하여 관계 당국에 보고하지 아니하거나 거짓으로 보고하는 행위

18. "양륙"(揚陸)이란 선박에서 보관하고 있는 수산물의 전부 또는 일부를 육상으로 옮기는 것을 말한다.
