영화 및 비디오물의 진흥에 관한 법률 시행령 제22조의2(영화상영관의 폐업신고 등)

① 법 제46조의2제1항에 따라 폐업신고를 하려는 자는 문화체육관광부령으로 정하는 폐업신고서에 등록증을 첨부하여 시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

② 시장ㆍ군수ㆍ구청장은 법 제46조의2제2항에 따라 등록사항을 직권으로 말소하려는 경우에는 해당 영화상영관 경영자 또는 건물주 등 영화상영관의 관계인을 대상으로 다음 각 호의 어느 하나에 해당하는 사항을 확인해야 한다. 다만, 「부가가치세법」 제8조에 따라 관할세무서장에게 폐업신고를 하거나 관할세무서장이 사업자등록을 말소한 사실을 확인한 경우에는 그러하지 아니하다. <개정 2025.3.11>

③ 시장ㆍ군수ㆍ구청장은 법 제46조의2제2항에 따라 등록사항을 직권으로 말소하려는 경우에는 사전에 해당 영화상영관 경영자에게 통지하고, 직권 말소 예정 사실을 해당 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)의 인터넷 홈페이지에 20일 이상 게시하여야 한다.

④ 시장ㆍ군수ㆍ구청장은 법 제46조의2제2항에 따라 등록사항을 직권으로 말소한 경우에는 해당 영화상영관에 관한 다음 각 호의 사항을 공보에 공고하고, 해당 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구의 인터넷 홈페이지에 게시하여야 한다.
