Territorial Sea and Contiguous Zone Act, Article 5 (Passage of foreign ships)

① 외국선박은 대한민국의 평화ㆍ공공질서 또는 안전보장을 해치지 아니하는 범위에서 대한민국의 영해를 무해통항(無害通航)할 수 있다. 외국의 군함 또는 비상업용 정부선박이 영해를 통항하려는 경우에는 대통령령으로 정하는 바에 따라 관계 당국에 미리 알려야 한다.

② 외국선박이 통항할 때 다음 각 호의 행위를 하는 경우에는 대한민국의 평화ㆍ공공질서 또는 안전보장을 해치는 것으로 본다. 다만, 제2호부터 제5호까지, 제11호 및 제13호의 행위로서 관계 당국의 허가ㆍ승인 또는 동의를 받은 경우에는 그러하지 아니하다.
