연근해어업의 구조개선 및 지원에 관한 법률 제20조(지원금의 환수)

Act on Structural Improvement and Support of Coastal and Offshore Fisheries, Article 20 (Recovery of Support Payments)

① 해양수산부장관이나 시ㆍ도지사는 지원금을 받은 자가 다음 각 호의 어느 하나에 해당하는 경우에는 그가 받은 지원금의 전부 또는 일부를 돌려받을 수 있다. <개정 2013.3.23, 2020.2.18, 2021.4.13, 2022.1.11>

1. 거짓이나 그 밖의 부정한 방법으로 지원금을 지급받은 경우

1. Where웨어 the^ð더 person퍼슨 received^r러시^v브드 the^ð더 support서포트 payments페이먼츠 by바이 false^f폴스 or오 other어^ð더 wrongful^r롱^f플 means;민즈

2. 잘못 지급된 경우

3. 제13조제1항제2호에 따른 폐업지원금을 지원받은 날부터 3년 이내에 제8조에 따라 감척 대상 어업으로 고지된 어업의 허가받은 어선ㆍ어구를 매입 또는 임차하여 「수산업법」 제45조에 따라 어업허가를 받은 자의 지위를 승계하는 경우

② 해양수산부장관이나 시ㆍ도지사는 제1항에 따라 돌려받는 경우에 지원금을 반환할 자가 기간 이내에 반환하지 아니하면 국세 또는 지방세 체납처분의 예에 따라 돌려받을 수 있다. <개정 2013.3.23, 2020.2.18>

③ 제1항에 따른 지원금의 환수에 대한 기준과 절차 등 필요한 사항은 해양수산부령으로 정한다. <신설 2021.4.13>
