연구개발특구의 육성에 관한 특별법 제16조의6(규제의 신속확인)

① 특구에서 신기술을 활용하여 실증 또는 사업을 하려는 자는 과학기술정보통신부장관에게 특구 내 신기술 창출과 관련된 규제의 존재 또는 적용 여부에 대하여 확인하여 줄 것을 요청할 수 있다.

② 제1항에 따른 확인요청을 받은 과학기술정보통신부장관은 해당 요청이 다른 기관의 소관 사항인 경우 관계기관의 장에게 통보하여야 한다.

③ 제2항에 따라 통보를 받은 관계기관의 장은 30일 이내에 소관 업무 여부 및 허가등의 필요 여부를 과학기술정보통신부장관에게 회신하여야 한다. 30일 이내에 회신하지 아니하는 경우 소관 업무에 해당하지 아니하거나 해당 관계기관의 장의 허가등이 필요하지 아니한 것으로 본다.

④ 관계기관의 장은 제1항에 따른 확인요청에 대하여 관계 법령에 따른 허가등이 필요하다고 판단하는 경우에는 허가등에 필요한 조건 및 절차 등을 과학기술정보통신부장관에게 회신하여야 하며, 과학기술정보통신부장관은 이를 요청자에게 즉시 통보하여야 한다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 규제의 신속확인 등에 필요한 사항은 대통령령으로 정한다.
