연구개발특구의 육성에 관한 특별법 제16조의5(실증특례 지정의 취소)

① 과학기술정보통신부장관은 실증특례의 지정을 받은 자가 다음 각 호의 어느 하나에 해당하는 경우에는 시정을 명하거나 위원회의 심의ㆍ의결을 거쳐 실증특례의 지정을 취소할 수 있다. 다만, 제1호에 해당하는 경우에는 그 지정을 취소하여야 한다. <개정 2023.3.21, 2024.10.22>

② 과학기술정보통신부장관은 실증특례의 지정에 따른 신기술의 이용 또는 제공 등으로 국민의 생명ㆍ안전에 위해가 발생하거나 현저한 위해가 발생할 우려가 있는 경우에는 해당 신기술의 이용 또는 제공 등에 대한 일시적 중지 등 필요한 조치를 명할 수 있다.

③ 과학기술정보통신부장관은 제1항에 따라 실증특례의 지정을 취소하려는 경우에는 청문을 하여야 한다.

④ 제1항에 따라 실증특례의 지정이 취소된 자는 해당 신기술을 이용 또는 제공 등을 하여서는 아니 된다.
