엔지니어링산업 진흥법 제25조(행정처분 효과의 승계)

① 제23조제1항에 따라 지위가 승계되면 종전의 엔지니어링사업자에 대한 제24조제1항에 따른 행정처분의 효과는 그 처분일부터 1년간 양수인, 합병 후 존속하는 법인이나 합병으로 설립되는 법인(이하 "양수인등"이라 한다) 또는 상속인에 승계된다. <개정 2025.12.2>

② 제23조제1항에 따라 지위가 승계되면 종전의 엔지니어링사업자에 대하여 제24조제1항에 따라 행정처분 절차가 진행 중일 때에는 양수인등 또는 상속인에 대하여 그 절차를 계속 진행할 수 있다. 다만, 양수인등이 양수 또는 합병 시에 그 처분 또는 위반 사실을 알지 못하였음을 증명하는 경우에는 그러하지 아니하다. <개정 2025.12.2>

③ 양수인등은 제23조제1항에 따라 지위를 승계하는 경우 종전의 엔지니어링사업자가 제24조제1항에 따른 행정처분의 절차가 진행 중인지 및 행정처분을 받은 이력이 있는지 여부를 확인하여야 하며, 산업통상부장관은 양수인등이 그 확인을 요청하는 경우 산업통상부령으로 정하는 바에 따라 확인하는 서류를 발급할 수 있다. <신설 2025.12.2>
