엔지니어링산업 진흥법 제23조(엔지니어링사업자의 지위승계)

① 엔지니어링사업자가 엔지니어링사업의 전부 또는 일부를 양도하거나 사망한 경우 또는 법인인 엔지니어링사업자가 합병한 경우에는 그 양수인ㆍ상속인 또는 합병 후 존속하는 법인이나 합병으로 설립되는 법인이 그 엔지니어링사업자의 지위를 승계한다.

(1) Where웨어 an앤 engineering엔저니^r링 business비즈니스 operator아퍼^r레이터 transfers트^r랜스^f퍼즈 all올 or오 part파트 of어^v브 the^ð디 engineering엔저니^r링 business비즈니스 or오 dies,다이즈 or오 where웨어 a어 corporate코퍼^r럿 engineering엔저니^r링 business비즈니스 operator아퍼^r레이터 merges,머지즈 the^ð더 transferee,트^r랜스^f퍼^r리 heir,에어 or오 the^ð더 corporation코퍼^r레이션 surviving서^v바이^v빙 the^ð더 merger머저 or오 established이스태블리시트 by바이 the^ð더 merger머저 shall섈 succeed석시드 to투 the^ð더 status스태터스 of어^v브 that^ð댓 engineering엔저니^r링 business비즈니스 operator.아퍼^r레이터

② 제1항에 따라 엔지니어링사업자의 지위를 승계한 자는 그 사유가 발생한 날부터 30일 이내에 산업통상부령으로 정하는 바에 따라 산업통상부장관에게 그 사실을 신고하여야 한다. <개정 2013.3.23, 2025.10.1>

③ 산업통상부장관은 제2항에 따른 신고를 받은 날부터 30일 이내에 신고수리 여부를 신고인에게 통지하여야 하며, 그 신고사항에 대하여 보완이 필요하다고 인정할 때에는 3개월 이내에서 기간을 정하여 이를 보완하게 할 수 있다. <신설 2025.12.2>

④ 산업통상부장관이 제3항에 따른 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2025.12.2>
