에너지이용 합리화법 시행령 제51조(업무의 위탁)
Enforcement Decree of the Energy Use Rationalization Act, Article 51 (Entrustment of Duties)
① 기후에너지환경부장관 또는 시ㆍ도지사는 법 제69조제3항에 따라 다음 각 호의 업무를 공단에 위탁한다. <개정 2009.7.27, 2013.3.23, 2017.11.7, 2018.7.17, 2023.1.17, 2025.10.1>
(1) Pursuant to Article 69 (3) of the Act, the Minister of Climate, Energy and Environment or the Mayor/Do Governor entrusts the following duties to the Agency:
1. 법 제11조에 따른 에너지사용계획의 검토
1. Review of energy use plans under Article 11 of the Act;
2. 법 제12조에 따른 이행 여부의 점검 및 실태파악
2. Inspection and fact-finding on compliance under Article 12 of the Act;
3. 법 제15조제3항에 따른 효율관리기자재의 측정 결과 신고의 접수
3. Receipt of reports of measurement results of efficiency-controlled equipment under Article 15 (3) of the Act;
4. 법 제19조제3항에 따른 대기전력경고표지대상제품의 측정 결과 신고의 접수
4. Receipt of reports of measurement results of products subject to standby power warning labels under Article 19 (3) of the Act;
5. 법 제20조제2항에 따른 대기전력저감대상제품의 측정 결과 신고의 접수
5. Receipt of reports of measurement results of products subject to standby power reduction under Article 20 (2) of the Act;
6. 법 제22조제3항 및 제4항에 따른 고효율에너지기자재 인증 신청의 접수 및 인증
6. Receipt of applications for and certification of high-efficiency energy equipment under Article 22 (3) and (4) of the Act;
7. 법 제23조제1항에 따른 고효율에너지기자재의 인증취소 또는 인증사용 정지명령
7. Revocation of certification of high-efficiency energy equipment or orders to suspend use of certification under Article 23 (1) of the Act;
8. 법 제25조에 따른 에너지절약전문기업의 등록
8. Registration of energy-saving specialized enterprises under Article 25 of the Act;
9. 법 제29조제1항에 따른 온실가스배출 감축실적의 등록 및 관리
9. Registration and management of greenhouse gas emission reduction performance under Article 29 (1) of the Act;
10. 법 제31조제1항에 따른 에너지다소비사업자 신고의 접수
10. Receipt of reports from large energy consumers under Article 31 (1) of the Act;
11. 법 제32조제3항에 따른 진단기관의 관리ㆍ감독
11. Management and supervision of audit institutions under Article 32 (3) of the Act;
12. 법 제32조제5항에 따른 에너지관리지도
12. Energy management guidance under Article 32 (5) of the Act;
12의2. 법 제32조제7항에 따른 진단기관의 평가 및 그 결과의 공개
12-2. Evaluation of audit institutions and disclosure of the results under Article 32 (7) of the Act;
12의3. 법 제36조의2제4항에 따른 냉난방온도의 유지ㆍ관리 여부에 대한 점검 및 실태 파악
12-3. Inspection and fact-finding on whether heating and cooling temperatures are maintained and managed under Article 36-2 (4) of the Act;
13. 법 제39조제2항 및 제4항에 따른 검사대상기기의 검사
13. Inspection of equipment subject to inspection under Article 39 (2) and (4) of the Act;
14. 법 제39조제3항에 따른 검사증의 발급(제13호에 따른 검사만 해당한다)
14. Issuance of inspection certificates under Article 39 (3) of the Act (limited to inspections under subparagraph 13);
15. 법 제39조제7항에 따른 검사대상기기의 폐기, 사용 중지, 설치자 변경 및 검사의 전부 또는 일부가 면제된 검사대상기기의 설치에 대한 신고의 접수
15. Receipt of reports on scrapping, suspension of use, change of installer of equipment subject to inspection, and installation of equipment subject to inspection for which inspection has been wholly or partially exempted under Article 39 (7) of the Act;
16. 법 제40조제3항에 따른 검사대상기기관리자의 선임ㆍ해임 또는 퇴직신고의 접수
16. Receipt of reports on appointment, dismissal, or retirement of managers of equipment subject to inspection under Article 40 (3) of the Act.
② 기후에너지환경부장관 또는 시ㆍ도지사는 법 제69조제3항에 따라 다음 각 호의 업무를 공단 또는 「국가표준기본법」 제23조에 따라 인정받은 시험ㆍ검사기관 중 기후에너지환경부장관이 지정하여 고시하는 기관에 위탁한다. <개정 2013.3.23, 2017.11.7, 2025.10.1>
(2) Pursuant to Article 69 (3) of the Act, the Minister of Climate, Energy and Environment or the Mayor/Do Governor entrusts the following duties to the Agency or an institution designated and publicly notified by the Minister of Climate, Energy and Environment from among testing and inspection institutions accredited under Article 23 of the Framework Act on National Standards:
1. 법 제39조제1항에 따른 검사대상기기의 검사
1. Inspection of equipment subject to inspection under Article 39 (1) of the Act;
2. 법 제39조제3항에 따른 검사증의 발급(제1호에 따른 검사만 해당한다)
2. Issuance of inspection certificates under Article 39 (3) of the Act (limited to inspections under subparagraph 1);
3. 법 제39조의2제1항에 따른 수입 검사대상기기의 검사
3. Inspection of imported equipment subject to inspection under Article 39-2 (1) of the Act;
4. 법 제39조의2제2항에 따른 검사증의 발급
4. Issuance of inspection certificates under Article 39-2 (2) of the Act.
③ 기후에너지환경부장관 또는 시ㆍ도지사는 제2항에 따라 업무를 위탁한 경우에는 위탁받은 기관 및 위탁업무의 내용 등을 인터넷 홈페이지나 관보 또는 공보에 게재하여야 한다. <신설 2017.11.7, 2025.10.1>
(3) Where the Minister of Climate, Energy and Environment or the Mayor/Do Governor has entrusted duties under paragraph (2), the Minister or Mayor/Do Governor shall post the entrusted institution and the content of the entrusted duties on the website, in the Official Gazette, or in a public bulletin.
