Fishing Villages and Fishing Ports Act, Article 2 (Definitions)

The meaning of the terms used in this Act is as follows:
1. "어촌"이란 「수산업ㆍ어촌 발전 기본법」 제3조제6호에 따른 어촌을 말한다.
1. "Fishing village" means a fishing village under Article 3, subparagraph 6 of the Framework Act on Fisheries and Fishing Communities Development.
2. "어촌종합개발사업"이란 어촌을 대상으로 시행하는 다음 각 목의 사업을 말한다.
2. "Comprehensive fishing village development project" means any of the following projects carried out for fishing villages:
가. 연안시설의 정비, 수산자원의 조성, 수산물 유통 및 가공 시설의 확충 등 수산업생산기반시설의 개선ㆍ확충 사업
(a) Projects to improve and expand fisheries production base facilities, such as improvement of coastal facilities, creation of fishery resources, and expansion of fishery product distribution and processing facilities;
나. 어촌주민의 생활수준 향상 및 복지 증진을 위하여 필요한 생활환경의 개선 및 관련 부대사업
(b) Projects to improve the living environment and related incidental projects necessary to improve the standard of living and promote welfare of fishing village residents;
다. 어촌주민의 소득을 높이고 지역경제를 활성화하기 위하여 어촌의 자연경관, 특산물 또는 그 지역 특유의 풍속 등을 활용하여 시행하는 사업
(c) Projects carried out using the natural scenery, specialty products, or customs unique to the area of a fishing village, in order to raise the income of fishing village residents and vitalize the local economy.
3. "어항"이란 천연 또는 인공의 어항시설을 갖춘 수산업 근거지로서 제17조에 따라 지정ㆍ고시된 것을 말하며 그 종류는 다음과 같다.
3. "Fishing port" means a base for the fisheries industry equipped with natural or artificial fishing port facilities that has been designated and publicly notified under Article 17, and the types are as follows:
가. 국가어항: 이용 범위가 전국적인 어항 또는 섬, 외딴 곳에 있어 어장(「어장관리법」 제2조제1호에 따른 어장을 말한다. 이하 같다)의 개발 및 어선의 대피에 필요한 어항
(a) National fishing port: a fishing port whose scope of use is nationwide, or a fishing port located on an island or a remote place that is necessary for developing fishing grounds (meaning fishing grounds under Article 2, subparagraph 1 of the Fishing Ground Management Act; the same shall apply hereinafter) and for evacuation of fishing vessels;
나. 지방어항: 이용 범위가 지역적이고 연안어업에 대한 지원의 근거지가 되는 어항
(b) Local fishing port: a fishing port whose scope of use is regional and which serves as a base for supporting coastal fisheries;
다. 어촌정주어항(漁村定住漁港): 어촌의 생활 근거지가 되는 소규모 어항
(c) Fishing village settlement port: a small-scale fishing port serving as a base for the life of a fishing village;
라. 마을공동어항: 어촌정주어항에 속하지 아니한 소규모 어항으로서 어업인들이 공동으로 이용하는 항포구
(d) Village community port: a small-scale fishing port not belonging to a fishing village settlement port, being a port or harbor jointly used by fishers.
4. "어항구역"이란 어항의 수역(水域) 및 육역(陸域)을 말한다.
4. "Fishing port area" means the water area and land area of a fishing port.
5. "어항시설"이란 어항구역 안에 있는 다음 각 목의 시설과 어항구역 밖에 있는 다음 가목 및 나목의 시설로서 해양수산부장관, 광역시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다) 또는 시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다)이 제17조에 따라 지정ㆍ고시한 것을 말한다.
5. "Fishing port facilities" means the following facilities within a fishing port area, and facilities in items (a) and (b) below outside a fishing port area that have been designated and publicly notified under Article 17 by the Minister of Oceans and Fisheries, the Mayor of a Metropolitan City, the Do Governor, the Special Self-Governing Province Governor (hereinafter referred to as a "Mayor/Do Governor"), or the mayor, county governor, or head of a Gu (meaning the head of an autonomous Gu; the same shall apply hereinafter):
가. 기본시설
(a) Basic facilities:
1) 방파제(防波堤)ㆍ방사제(防砂堤)ㆍ파제제(波除堤)ㆍ방조제(防潮堤)ㆍ도류제(導流堤)ㆍ수문ㆍ갑문(閘門)ㆍ호안(護岸)ㆍ둑ㆍ돌제(突堤)ㆍ흉벽(胸壁) 등 외곽시설
1) Outer facilities such as breakwaters, sand barriers, wave-dissipating dikes, seawalls, training jetties, sluices, lock gates, revetments, banks, groins, and parapets;
2) 안벽(岸壁)ㆍ물양장(物揚場)ㆍ계선부표(繫船浮標)ㆍ계선말뚝ㆍ잔교(棧橋)ㆍ부잔교(浮棧橋)ㆍ선착장ㆍ선양장(船揚場) 등 계류시설(繫留施設)
2) Mooring facilities such as quay walls, landing wharves, mooring buoys, mooring posts, piers, floating piers, boat landings, and slipways;
3) 항로(航路)ㆍ정박지ㆍ선회장(船回場) 등 수역시설
3) Water area facilities such as channels, anchorages, and turning basins;
나. 기능시설
(b) Functional facilities:
1) 철도ㆍ도로ㆍ다리ㆍ주차장ㆍ헬리포트 등 수송시설
1) Transportation facilities such as railways, roads, bridges, parking lots, and heliports;
2) 항로 표지, 신호ㆍ조명 시설 등 항행보조시설
2) Navigation aid facilities such as navigation marks and signal and lighting facilities;
3) 어선 건조장ㆍ수리장, 어구 건조장, 어구 제작장ㆍ수리장, 선양시설, 야적장, 기자재 창고 등 어선ㆍ어구 보전시설
3) Fishing vessel and fishing gear maintenance facilities such as fishing vessel building and repair yards, fishing gear drying yards, fishing gear manufacturing and repair yards, slipway facilities, open storage yards, and equipment warehouses;
4) 급수(給水)ㆍ급빙(給氷)ㆍ급유(給油) 시설, 전기수용설비ㆍ선수품보급장(船需品補給場) 등 보급시설
4) Supply facilities such as water supply, ice supply, and fuel supply facilities, electricity receiving equipment, and ship stores supply yards;
5) 수산물시장ㆍ수산물위판장ㆍ수산물직매장ㆍ수산물집하장 및 활어(活魚) 일시 보관시설 등 수산물의 유통ㆍ판매ㆍ보관 시설과 이러한 시설에 바닷물을 끌어오거나 내보내기 위한 시설
5) Facilities for distribution, sale, and storage of fishery products, such as fishery product markets, fishery product wholesale auction sites, fishery product direct sales centers, fishery product collection centers, and temporary live fish storage facilities, and facilities for drawing seawater into or discharging it from such facilities;
6) 하역기계, 제빙(製氷)ㆍ냉동ㆍ냉장 시설, 수산물 가공공장 등 수산물 처리ㆍ가공 시설
6) Fishery product handling and processing facilities such as cargo handling machinery, ice-making, freezing, and cold-storage facilities, and fishery product processing plants;
7) 육상 무선전신ㆍ전화시설, 어업 기상신호시설 등 어업용 통신시설
7) Communication facilities for fisheries such as land radiotelegraph and telephone facilities and fishery weather signal facilities;
8) 어항관리시설ㆍ해양관측시설, 관계 법령에 따른 선박출입항 신고기관 등 해양수산 관련 공공시설
8) Public facilities related to oceans and fisheries such as fishing port management facilities, ocean observation facilities, and agencies for reporting entry and departure of vessels under relevant statutes;
9) 환경오염방지를 위한 오수ㆍ폐수 처리시설, 도수시설(導水施設), 폐유ㆍ폐선(廢船) 처리시설 등 어항정화시설
9) Fishing port purification facilities such as sewage and wastewater treatment facilities for preventing environmental pollution, water conveyance facilities, and waste oil and abandoned vessel treatment facilities;
10) 수산종자생산시설, 수산종자 배양장 등 수산자원 육성시설
10) Fishery resource fostering facilities such as fishery seed production facilities and fishery seed hatcheries;
11) 기능시설의 운영ㆍ관리를 위한 업무용시설
11) Office facilities for the operation and management of functional facilities;
다. 어항편익시설
(c) Fishing port amenity facilities:
1) 진료시설ㆍ복지회관ㆍ체육시설 등 복지시설
1) Welfare facilities such as medical facilities, welfare centers, and sports facilities;
2) 전시관ㆍ도서관ㆍ학습관ㆍ공연장 등 문화시설
2) Cultural facilities such as exhibition halls, libraries, learning centers, and performance halls;
3) 광장ㆍ조경시설 등 어항의 환경정비를 위한 시설
3) Facilities for improving the environment of fishing ports, such as plazas and landscaping facilities;
4) 유람선ㆍ낚시어선ㆍ모터보트ㆍ요트ㆍ윈드서핑 등의 수용을 위한 레저용 기반시설
4) Leisure infrastructure facilities for accommodating excursion boats, fishing boats, motor boats, yachts, and windsurfing;
5) 지역특산품 판매장, 생선횟집 등 관광객 이용시설
5) Facilities for tourists such as local specialty product stores and raw fish restaurants;
6) 숙박시설ㆍ목욕시설ㆍ오락시설 등 휴게시설
6) Rest facilities such as accommodation facilities, bathing facilities, and recreation facilities;
7) 그 밖에 대통령령으로 정하는 주민편익시설
7) Other resident amenity facilities prescribed by Presidential Decree;
라. 가목부터 다목까지의 시설을 조성하기 위한 부지와 수역
(d) Sites and water areas for creating the facilities in items (a) through (c).
6. "어항개발사업"이란 제19조에 따른 어항개발계획에 따라 시행하는 다음 각 목의 사업을 말한다.
6. "Fishing port development project" means any of the following projects carried out in accordance with the fishing port development plan under Article 19:
가. 어항기본사업: 종합적이고 기본적인 어항시설의 신설 및 이에 부수되는 준설ㆍ매립 등의 사업
(a) Basic fishing port project: a project for newly constructing comprehensive and basic fishing port facilities and incidental dredging and reclamation;
나. 어항정비사업: 어항시설의 변경ㆍ보수ㆍ보강ㆍ이전ㆍ확장 및 이에 부수되는 준설ㆍ매립 등의 사업
(b) Fishing port improvement project: a project for alteration, repair, reinforcement, relocation, and expansion of fishing port facilities and incidental dredging and reclamation;
다. 어항환경개선사업: 어항정화 및 어촌관광 활성화를 위한 어항환경개선사업
(c) Fishing port environment improvement project: a fishing port environment improvement project for fishing port purification and vitalization of fishing village tourism;
라. 레저관광기반시설사업: 해양관광 지원을 위한 제5호다목4)에 따른 레저용 기반시설 설치 및 보수 등의 사업
(d) Leisure and tourism infrastructure project: a project for installation and repair of leisure infrastructure facilities under subparagraph 5 (c) 4) to support marine tourism.
7. "어항통합정보시스템"이란 어항 통계자료 등을 체계적으로 수집ㆍ관리하고 어항정책의 수립ㆍ추진과 관련된 정보관리 및 민원사무 등을 전자적으로 처리하기 위하여 구축한 전자정보통신체계를 말한다.
7. "Integrated fishing port information system" means an electronic information and communications system established to systematically collect and manage fishing port statistics and to electronically process information management related to establishing and promoting fishing port policies and civil petition matters.
8. "폐기물"이란 폐어구(廢漁具), 쓰레기, 연소물(燃燒物), 오염 침전물, 폐유, 폐산(廢酸), 폐(廢)알칼리, 동물의 사체 등으로서 사람의 생활이나 사업활동에 필요하지 아니하게 된 물질을 말한다.
8. "Waste" means abandoned fishing gear, garbage, burnt matter, contaminated sediments, waste oil, waste acid, waste alkali, animal carcasses, etc. that have become unnecessary for human life or business activities.
9. "어촌ㆍ어항재생"이란 인구 감소, 산업구조 변화 등으로 낙후된 어촌ㆍ어항을 연계ㆍ통합하여 접근성 및 정주여건 개선, 수산ㆍ관광 등 산업발전, 주민역량 강화 등을 통하여 사회ㆍ문화ㆍ경제ㆍ환경적으로 지역의 활력을 도모하는 것을 말한다.
9. "Fishing village and fishing port regeneration" means promoting the vitality of a region socially, culturally, economically, and environmentally by linking and integrating fishing villages and fishing ports that have fallen behind due to population decline, changes in industrial structure, etc., through improving accessibility and settlement conditions, developing industries such as fisheries and tourism, and strengthening the capacity of residents.
10. "어촌ㆍ어항재생사업"이란 어촌ㆍ어항재생을 위하여 제47조의3에 따른 어촌ㆍ어항재생사업계획에 따라 추진하는 사업을 말한다.
10. "Fishing village and fishing port regeneration project" means a project promoted in accordance with the fishing village and fishing port regeneration project plan under Article 47-3 for fishing village and fishing port regeneration.
