어린이놀이시설 안전관리법 제2조(정의)

1. "어린이놀이기구"란 어린이가 놀이를 위하여 사용할 수 있도록 제조된 그네, 미끄럼틀, 공중놀이기구, 회전놀이기구 등으로서 「어린이제품 안전 특별법」 제2조제9호에 따른 안전인증대상어린이제품을 말한다.

2. "어린이놀이시설"이라 함은 어린이놀이기구가 설치된 실내 또는 실외의 놀이터 또는 어린이놀이기구가 설치되지 아니하였으나 어린이에게 놀이활동을 제공하는 장소로서 대통령령으로 정하는 것을 말한다.

3. "관리감독기관의 장"이란 어린이놀이시설의 안전한 유지관리를 위하여 다음 각 목의 구분에 따라 어린이놀이시설을 관리ㆍ감독하는 행정기관의 장을 말한다.

5. "관리주체"라 함은 어린이놀이시설의 소유자로서 관리책임이 있는 자, 다른 법령에 의하여 어린이놀이시설의 관리자로 규정된 자 또는 그 밖에 계약에 의하여 어린이놀이시설의 관리책임을 진 자를 말한다.

7. "안전점검"이란 어린이놀이기구가 설치된 어린이놀이시설의 관리주체 또는 관리주체로부터 해당 어린이놀이시설의 안전관리를 위임받은 자가 육안 또는 점검기구 등에 의하여 검사를 하여 어린이놀이시설의 시설 결함에 의한 위험요인을 조사하는 행위를 말한다.

7의2. "안전성평가"란 어린이놀이기구가 설치되지 아니한 어린이놀이시설을 설치하는 자 및 해당 어린이놀이시설의 관리주체 또는 관리주체로부터 어린이놀이시설의 안전관리를 위임받은 자가 어린이놀이시설에서 발생 가능한 안전사고 유형을 식별하고 해당 사고를 유발하는 위험요소를 찾아내어 개선하는 일련의 활동을 말한다.

8. "안전진단"이라 함은 제4조의 안전검사기관이 어린이놀이시설에 대하여 조사ㆍ측정ㆍ안전성 평가 등을 하여 해당 어린이놀이시설의 물리적ㆍ기능적 결함을 발견하고 그에 대한 신속하고 적절한 조치를 하기 위하여 수리ㆍ개선 등의 방법을 제시하는 행위를 말한다.
