어린이놀이시설 안전관리법 제17조의2(어린이놀이시설의 지도ㆍ감독 등)

① 관리감독기관의 장은 어린이놀이시설의 안전관리를 위하여 매년 어린이놀이시설 지도ㆍ점검계획을 수립ㆍ시행하여야 한다.

② 제1항의 계획에 따른 지도ㆍ점검 결과 시설개선이 필요하다고 인정되는 경우 관리감독기관의 장은 관리주체에게 어린이놀이시설의 규모 및 종류 등을 고려하여 정한 기간 내에 그 시설개선을 명할 수 있다. 이 경우 그 기간 내에 이행할 수 없는 불가피한 사유가 있는 경우에는 최소한의 범위에서 그 기간을 연장할 수 있다.

③ 제2항에 따라 시설개선의 명령을 받은 관리주체는 수리ㆍ보수 등 필요한 조치를 하여야 한다.

④ 관리감독기관의 장은 시설개선의 명령이 이행되었는지를 확인ㆍ점검하여야 한다.

⑤ 관리감독기관의 장은 제4항에 따른 이행 점검 결과 시설개선이 이루어지지 않았다고 판단될 경우 관리주체에게 해당 어린이놀이시설을 보완하도록 명하여야 한다.

⑥ 제1항에 따른 지도ㆍ점검계획의 내용, 지도ㆍ점검의 방법 등에 필요한 사항은 대통령령으로 정한다.
