어린이놀이시설 안전관리법 제16조(안전진단의 실시)

① 제15조제3항의 규정에 따라 안전진단 신청을 받은 안전검사기관은 행정안전부령으로 정하는 절차 및 방법에 따라 안전진단을 실시하고 그 결과를 신청인 및 해당 관리감독기관의 장에게 통보하여야 한다. <개정 2008.2.29, 2008.12.19, 2011.5.30, 2013.3.23, 2014.11.19, 2017.7.26>

② 제1항의 규정에 따라 안전진단 결과를 통보받은 관리주체는 해당 어린이놀이시설이 제11조제1항에 따른 시설기준 및 기술기준에 적합하지 아니한 경우에는 수리ㆍ보수 등 필요한 조치를 실시하고 안전검사기관으로부터 해당 어린이놀이시설의 재사용 여부를 확인받아야 한다. <개정 2026.2.27>

③ 제1항의 규정에 따라 안전진단 결과를 통보받은 관리감독기관의 장은 제2항의 규정에 따라 재사용 불가 판정을 받은 어린이놀이시설이 안전을 침해할 것으로 판단되는 경우에는 그 철거를 명할 수 있다. <개정 2011.5.30>

④ 안전검사기관은 안전진단을 행함에 있어서 대통령령이 정하는 바에 따라 수수료를 받을 수 있다.

⑤ 관리주체는 어린이놀이시설을 이용 금지ㆍ폐쇄ㆍ철거하는 경우에는 어린이 등이 출입하지 못하도록 조치를 하고 해당 관리감독기관의 장에게 그 사실을 통보하여야 한다. <개정 2011.5.30>
