약관의 규제에 관한 법률 제24조(약관 분쟁조정협의회의 설치 및 구성)

① 제17조를 위반한 약관 또는 이와 비슷한 유형의 약관으로서 대통령령으로 정하는 약관과 관련된 분쟁을 조정하기 위하여 「독점규제 및 공정거래에 관한 법률」 제72조제1항에 따른 한국공정거래조정원(이하 "조정원"이라 한다)에 약관 분쟁조정협의회(이하 "협의회"라 한다)를 둔다. <개정 2020.12.29>

② 협의회는 위원장 1명을 포함한 9명의 위원으로 구성하며, 위원장은 상임으로 한다. <개정 2023.8.8>

(2) The^ð더 Council카운슬 shall섈 consist컨시스트 of어^v브 nine나인 members멤버즈 including인클루딩 one원 chairperson,체어퍼슨 and앤드 the^ð더 chairperson체어퍼슨 shall섈 serve서^v브 on안 a어 full-time^f풀-타임 basis.베이시스

③ 협의회 위원장은 조정원의 장의 제청으로 공정거래위원회 위원장이 위촉한다.

(3) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Council카운슬 shall섈 be비 commissioned커미션드 by바이 the^ð더 Chairperson체어퍼슨 of어^v브 the^ð더 Fair^f페어 Trade트^r레이드 Commission커미션 upon어판 the^ð더 recommendation^r레커먼데이션 of어^v브 the^ð더 head헤드 of어^v브 the^ð더 Mediation미디에이션 Agency.에이전시

④ 협의회 위원장이 사고로 직무를 수행할 수 없을 때에는 협의회의 위원장이 지명하는 협의회 위원이 그 직무를 대행한다.

(4) Where웨어 the^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Council카운슬 is이즈 unable어네이블 to투 perform퍼^f폼 his히즈 or오 her허 duties두티즈 due두 to투 an앤 unavoidable어너^v보이더블 cause,카즈 a어 member멤버 of어^v브 the^ð더 Council카운슬 designated데지그네이티드 by바이 the^ð더 chairperson체어퍼슨 shall섈 act액트 on안 his히즈 or오 her허 behalf.비해^f프

⑤ 협의회 위원은 약관규제ㆍ소비자 분야에 경험 또는 전문지식이 있는 사람으로서 다음 각 호의 어느 하나에 해당하는 사람 중에서 조정원의 장의 제청으로 공정거래위원회 위원장이 임명하거나 위촉한다. <개정 2023.8.8>

(5) Members멤버즈 of어^v브 the^ð더 Council카운슬 shall섈 be비 appointed어포인티드 or오 commissioned커미션드 by바이 the^ð더 Chairperson체어퍼슨 of어^v브 the^ð더 Fair^f페어 Trade트^r레이드 Commission,커미션 upon어판 the^ð더 recommendation^r레커먼데이션 of어^v브 the^ð더 head헤드 of어^v브 the^ð더 Mediation미디에이션 Agency,에이전시 from^f프^r럼 among어멍 persons퍼슨즈 who후 have해^v브 experience익스피^r리언스 or오 expertise엑스퍼티즈 in인 the^ð더 regulation^r레귤레이션 of어^v브 terms텀즈 and앤드 conditions컨디션즈 or오 in인 consumer컨수머 affairs어^f페어즈 and앤드 who후 fall^f폴 under언더 any에니 of어^v브 the^ð더 following:^f팔로잉

⑥ 협의회 위원의 임기는 3년으로 하되, 연임할 수 있다.

(6) The^ð더 term텀 of어^v브 office오^f피스 of어^v브 members멤버즈 of어^v브 the^ð더 Council카운슬 shall섈 be비 three^θ쓰^r리 years,이어즈 and앤드 they^ð데이 may메이 be비 reappointed.^r리어포인티드

⑦ 협의회 위원 중 결원이 생긴 때에는 제5항에 따라 보궐위원을 위촉하여야 하며, 그 보궐위원의 임기는 전임자의 남은 임기로 한다.

⑧ 협의회의 회의 등 업무지원을 위하여 별도 사무지원 조직을 조정원 내에 둔다.
