액화석유가스의 안전관리 및 사업법 제49조의5(굴착공사의 협의ㆍ순회점검)

① 액화석유가스 충전사업 중 산업통상부령으로 정하는 사업 및 액화석유가스 집단공급사업이 허가된 지역에서 액화석유가스배관 파손사고의 위험성이 높은 굴착공사로서 산업통상부령으로 정하는 굴착공사를 하려는 자는 액화석유가스배관을 보호하기 위하여 산업통상부령으로 정하는 바에 따라 해당 액화석유가스 충전사업자 또는 액화석유가스 집단공급사업자와 안전조치 방법 등을 협의하여야 하며, 협의를 요청받은 액화석유가스 충전사업자 및 액화석유가스 집단공급사업자는 정당한 사유가 없으면 이에 응하여야 한다. 다만, 제49조의4제1항 전단에 따라 시장ㆍ군수ㆍ구청장에게 평가서를 제출한 자는 그러하지 아니하다. <개정 2025.10.1>

② 액화석유가스 충전사업자 및 액화석유가스 집단공급사업자와 굴착공사를 하려는 자는 제1항에 따라 협의를 한 경우에는 산업통상부령으로 정하는 바에 따라 협의서를 작성하고 그 협의 내용을 지켜야 한다. <개정 2025.10.1>

③ 액화석유가스배관이 지하에서 철도(도시철도를 포함한다)나 도로를 건설하는 공사 및 그 밖에 산업통상부령으로 정하는 공사의 공사장을 통과하는 경우에 그 액화석유가스배관을 관리하는 액화석유가스 충전사업자 또는 액화석유가스 집단공급사업자와 그 공사의 시행자는 산업통상부령으로 정하는 바에 따라 합동 감시체계를 구축하고 정기적으로 순회점검을 하여야 한다. <개정 2025.10.1>
