액화석유가스의 안전관리 및 사업법 제35조(시설의 시공ㆍ관리 및 시공기록 등의 보존ㆍ제출)

① 액화석유가스의 충전시설, 집단공급시설, 판매시설, 영업소시설, 저장시설 또는 사용시설(이하 "액화석유가스시설"이라 한다)을 시공하려는 자는 「건설산업기본법」 제9조에 따라 가스시설시공업의 등록을 한 자(이하 "가스시설시공업자"라 한다)이어야 한다.

② 산업통상부령으로 정하는 규모 이상의 가스공급시설 또는 가스사용시설의 설치공사나 변경공사를 시공ㆍ관리하려는 가스시설시공업자는 산업통상부령으로 정하는 바에 따라 해당 액화석유가스 배관망공급사업자가 가스공급시설의 공사계획, 가스공급능력 등에 미치는 영향을 검토할 수 있도록 시공할 내용을 액화석유가스 배관망공급사업자에게 미리 알려주어야 하며, 액화석유가스 배관망공급사업자는 시공할 내용에 대하여 검토한 결과를 그 가스시설시공업자와 액화석유가스를 사용하려는 자에게 알려주어야 한다. <신설 2019.8.20, 2025.10.1>

③ 가스시설시공업자는 가스공급시설 또는 가스사용시설의 설치공사나 변경공사를 하는 경우에는 산업통상부령으로 정하는 시설별 시설기준과 기술기준에 적합하도록 시공ㆍ관리하여야 한다. <신설 2019.8.20, 2025.10.1>

④ 가스시설시공업자가 액화석유가스시설을 시공할 때에는 제5조제5항ㆍ제7항, 제8조제4항 및 제44조제1항에 따른 시설기준과 기술기준에 맞게 시공하여야 한다. <개정 2019.8.20, 2022.2.3>

⑤ 가스시설시공업자는 액화석유가스시설의 설치공사나 변경공사를 완공하면 산업통상부령으로 정하는 바에 따라 그 시공기록ㆍ완공도면(전산보조기억장치에 입력된 경우에는 그 입력된 자료로 할 수 있다. 이하 같다), 그 밖에 필요한 서류(이하 "시공기록 등"이라 한다)를 작성ㆍ보존하여야 한다. <개정 2019.8.20, 2025.10.1>

⑥ 가스시설시공업자는 산업통상부령으로 정하는 바에 따라 시공기록 등의 사본을 액화석유가스시설의 설치공사나 변경공사를 발주한 자에게 내주고, 완공도면의 사본을 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <개정 2019.8.20, 2025.10.1>

⑦ 제6항에 따라 시공기록 등의 사본을 받은 가스공급자 및 액화석유가스 저장자는 그 중 완공도면 사본을 산업통상부령으로 정하는 바에 따라 보존하여야 한다. <개정 2019.8.20, 2025.10.1>
