아동학대범죄의 처벌 등에 관한 특례법 제62조(비밀엄수 등 의무의 위반죄)

① 제35조제1항에 따른 비밀엄수 의무를 위반한 보조인, 진술조력인, 아동보호전문기관 직원과 그 기관장, 상담소 등에 근무하는 상담원과 그 기관장 및 제10조제2항 각 호에 규정된 사람(그 직에 있었던 사람을 포함한다)은 3년 이하의 징역이나 5년 이하의 자격정지 또는 3천만원 이하의 벌금에 처한다. 다만, 보조인인 변호사에 대하여는 「형법」 제317조제1항을 적용한다. <개정 2016.5.29>

② 제10조제3항을 위반하여 신고인의 인적사항 또는 신고인임을 미루어 알 수 있는 사실을 다른 사람에게 알려주거나 공개 또는 보도한 자는 3년 이하의 징역이나 3천만원 이하의 벌금에 처한다. <개정 2016.5.29>

③ 제35조제2항의 보도 금지 의무를 위반한 신문의 편집인ㆍ발행인 또는 그 종사자, 방송사의 편집책임자, 그 기관장 또는 종사자, 그 밖의 출판물의 저작자와 발행인은 500만원 이하의 벌금에 처한다.
