아동학대범죄의 처벌 등에 관한 특례법 제28조(검사의 송치)

① 검사는 제27조에 따라 아동보호사건으로 처리하는 경우에는 그 사건을 제18조제1항에 따른 관할 법원(이하 "관할 법원"이라 한다)에 송치하여야 한다.

② 검사는 아동학대범죄와 그 외의 범죄가 경합(競合)하는 경우에는 아동학대범죄에 대한 사건만을 분리하여 관할 법원에 송치할 수 있다.
