신탁법 제12조(수탁자의 임무 종료)

① 다음 각 호의 어느 하나에 해당하는 경우 수탁자의 임무는 종료된다.

② 제1항제1호, 제2호 또는 제4호에 따라 수탁자의 임무가 종료된 경우 수탁자의 상속인, 법정대리인 또는 청산인은 즉시 수익자에게 그 사실을 통지하여야 한다.

(2) Where웨어 the^ð더 duties두티즈 of어^v브 a어 trustee트^r러스티 terminate터머네잇 under언더 paragraph패^r러그^r래^f프 (1) 1, 2, or오 4, the^ð디 heir,에어 statutory스태처토^r리 agent,에이전트 or오 liquidator리퀴데이터 of어^v브 the^ð더 trustee트^r러스티 shall섈 immediately이미디어틀리 notify노우터^f파이 the^ð더 beneficiary베너^f피쉬에^r리 thereof.^ð데^r러^v브

③ 제1항제3호에 따라 수탁자의 임무가 종료된 경우 수탁자는 다음 각 호의 구분에 따라 해당 사실을 통지하여야 한다.

④ 제1항제1호, 제2호 또는 제4호에 따라 수탁자의 임무가 종료된 경우 수탁자의 상속인, 법정대리인 또는 청산인은 신수탁자(新受託者)나 신탁재산관리인이 신탁사무를 처리할 수 있을 때까지 신탁재산을 보관하고 신탁사무 인계에 필요한 행위를 하여야 하며, 즉시 수익자에게 그 사실을 통지하여야 한다.

⑤ 수탁자인 법인이 합병하는 경우 합병으로 설립된 법인이나 합병 후 존속하는 법인은 계속 수탁자로서의 권리ㆍ의무를 가진다. 수탁자인 법인이 분할하는 경우 분할에 의하여 수탁자로 정하여진 법인도 또한 같다.
