신탁법 제10조(위탁자 지위의 이전)

① 위탁자의 지위는 신탁행위로 정한 방법에 따라 제3자에게 이전할 수 있다.

② 제1항에 따른 이전 방법이 정하여지지 아니한 경우 위탁자의 지위는 수탁자와 수익자의 동의를 받아 제3자에게 이전할 수 있다. 이 경우 위탁자가 여럿일 때에는 다른 위탁자의 동의도 받아야 한다.

③ 제3조제1항제2호에 따라 신탁이 설정된 경우 위탁자의 상속인은 위탁자의 지위를 승계하지 아니한다. 다만, 신탁행위로 달리 정한 경우에는 그에 따른다.
