식품위생법 제60조의4(공제회에 대한 감독)

① 식품의약품안전처장은 공제회에 대하여 감독상 필요한 경우에는 그 업무에 관한 사항을 보고하게 하거나 자료의 제출을 명할 수 있으며, 소속 공무원으로 하여금 장부ㆍ서류, 그 밖의 물건을 검사하게 할 수 있다. <개정 2013.3.23, 2017.12.19>

② 제1항에 따라 조사 또는 검사를 하는 공무원 등은 그 권한을 표시하는 증표 및 조사기간, 조사범위, 조사담당자, 관계 법령 등 대통령령으로 정하는 사항이 기재된 서류를 가지고 이를 관계인에게 보여주어야 한다. <개정 2016.2.3>

③ 식품의약품안전처장은 공제회의 운영이 적정하지 아니하거나 자산상황이 불량하여 공제회원 등의 권익을 해칠 우려가 있다고 인정하면 업무집행방법 및 자산예탁기관의 변경, 가치가 없다고 인정되는 자산의 손실처리 등 필요한 조치를 명할 수 있다. <개정 2013.3.23, 2017.12.19>

④ 공제회가 제3항의 개선명령을 이행하지 아니한 경우 식품의약품안전처장은 공제회의 임직원의 징계ㆍ해임을 요구할 수 있다. <개정 2013.3.23, 2017.12.19>
