법원은 고의나 과실에 의하여 타인의 품종보호권이나 전용실시권을 침해함으로써 품종보호권자나 전용실시권자의 업무상 신용을 떨어뜨린 자에게는 품종보호권자나 전용실시권자의 청구에 의하여 손해배상을 갈음하거나 손해배상과 함께 품종보호권자나 전용실시권자의 업무상 신용회복을 위하여 필요한 조치를 명할 수 있다.
