Plant Variety Protection Act, Article 120 (Exclusion of Members)
① 종자위원이 다음 각 호의 어느 하나에 해당하는 경우에는 해당 조정에서 제척된다.
(1) A Seed Committee member shall be excluded from the relevant mediation in any of the following cases:
1. 다음 각 목의 사람이 해당 분쟁의 당사자가 되거나 당사자와 공동 권리자 또는 의무자의 관계에 있는 경우
1. Where any of the following persons is a party to the dispute or is in the relationship of joint right-holder or joint obligor with a party:
가. 종자위원
(a) The Seed Committee member;
나. 종자위원의 배우자 또는 배우자였던 사람
(b) The spouse or former spouse of the Seed Committee member;
2. 종자위원이 해당 분쟁의 당사자와 친족이거나 친족이었던 경우
2. Where the Seed Committee member is or was a relative of a party to the dispute;
3. 종자위원이 해당 분쟁에 관하여 증언이나 감정을 한 경우
3. Where the Seed Committee member has given testimony or appraisal in the dispute;
4. 종자위원이 해당 분쟁에 관하여 당사자의 대리인으로서 관여하고 있거나 관여하였던 경우
4. Where the Seed Committee member is or was involved in the dispute as an agent of a party.
② 종자위원에게 공정한 직무집행을 기대하기 어려운 사정이 있는 경우에 당사자는 종자위원회에 기피신청을 할 수 있으며, 종자위원회는 기피신청이 타당하다고 인정할 때에는 기피의 결정을 한다.
(2) Where there are circumstances that make it difficult to expect fair performance of duties from a Seed Committee member, a party may file a challenge to the Seed Committee, and the Seed Committee shall decide on the challenge when it recognizes the challenge to be well-founded.
③ 종자위원은 제1항 또는 제2항의 사유에 해당할 때에는 종자위원회 위원장의 허가를 받아 회피할 수 있다.
(3) A Seed Committee member who falls under the grounds of paragraph (1) or (2) may recuse himself or herself with the permission of the Chairperson of the Seed Committee.
