시설물의 안전 및 유지관리에 관한 특별법 제11조(안전점검의 실시)

① 관리주체는 소관 시설물의 안전과 기능을 유지하기 위하여 정기적으로 안전점검을 실시하여야 한다. 다만, 제6조제1항 단서에 해당하는 시설물의 경우에는 시장ㆍ군수ㆍ구청장이 안전점검을 실시하여야 한다.

② 관리주체는 시설물의 하자담보책임기간(동일한 시설물의 각 부분별 하자담보책임기간이 다른 경우에는 시설물의 부분 중 대통령령으로 정하는 주요 부분의 하자담보책임기간을 말한다)이 끝나기 전에 마지막으로 실시하는 정밀안전점검의 경우에는 안전진단전문기관이나 국토안전관리원에 의뢰하여 실시하여야 한다. <개정 2020.6.9>

③ 민간관리주체가 어음ㆍ수표의 지급불능으로 인한 부도(不渡) 등 부득이한 사유로 인하여 안전점검을 실시하지 못하게 될 때에는 관할 시장ㆍ군수ㆍ구청장이 민간관리주체를 대신하여 안전점검을 실시할 수 있다. 이 경우 안전점검에 드는 비용은 그 민간관리주체에게 부담하게 할 수 있다.

④ 제3항에 따라 시장ㆍ군수ㆍ구청장이 안전점검을 대신 실시한 후 민간관리주체에게 비용을 청구하는 경우에 해당 민간관리주체가 그에 따르지 아니하면 시장ㆍ군수ㆍ구청장은 지방세 체납처분의 예에 따라 징수할 수 있다.

⑤ 시설물의 종류에 따른 안전점검의 수준, 안전점검의 실시시기, 안전점검의 실시 절차 및 방법, 안전점검을 실시할 수 있는 자의 자격 등 안전점검 실시에 필요한 사항은 대통령령으로 정한다.
