Enforcement Decree of the Special Act on the Safety and Maintenance of Facilities, Article 9 (Qualifications of Responsible Engineers, etc.|6)

① 법 제11조제1항, 제12조제1항ㆍ제2항, 제13조제1항 또는 제40조제1항에 따라 안전점검등 또는 성능평가를 자신의 책임하에 실시할 수 있는 사람(이하 "책임기술자"라 한다)은 별표 5에 따른 자격요건을 갖추고 국토교통부령으로 정하는 바에 따라 법 제55조에 따른 시설물통합정보관리체계(이하 "시설물통합정보관리체계"라 한다)에 책임기술자로 등록한 사람으로 한다. <개정 2020.2.18>

② 책임기술자는 안전점검등 또는 성능평가를 실시할 때 필요한 경우에는 다음 각 호의 요건을 모두 갖춘 사람(이하 "참여기술자"라 한다)으로 하여금 자신의 감독하에 안전점검등 또는 성능평가를 하게 할 수 있다. 다만, 법 제11조에 따른 안전점검 및 법 제13조에 따른 긴급안전점검을 실시하는 참여기술자의 경우 제2호의 요건은 제외한다. <개정 2018.12.11, 2020.2.18>

1. 「건설기술 진흥법 시행령」 별표 1에 따른 토목ㆍ건축ㆍ안전관리(건설안전 기술자격자 분야만 해당한다) 분야의 초급기술인 이상 또는 「건축사법」에 따른 건축사의 자격요건을 갖춘 사람일 것
