Enforcement Decree of the Special Act on the Safety and Maintenance of Facilities, Article 24 (Temporary Failure to Meet Registration Criteria|5)
법 제31조제1항제9호 단서에서 "일시적으로 등록기준에 못 미치는 등 대통령령으로 정하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
The term "cases prescribed by Presidential Decree, such as temporarily falling short of the registration criteria" in the proviso to Article 31 (1) 9 of the Act means any of the following cases:
1. 제23조제1항에 따른 등록기준 중 기술인력에 해당하는 사람의 사망ㆍ실종 또는 퇴직으로 등록기준에 미치지 못하는 기간이 30일 이내인 경우
1. Where the period of failing to meet the registration criteria, because a person corresponding to the technical personnel under the registration criteria in Article 23 (1) has died, gone missing, or retired, is 30 days or less;
2. 제23조제1항에 따른 등록기준 중 자본금 기준에 미치지 못하는 경우로서 다음 각 목의 어느 하나에 해당하는 경우
2. Where the capital criterion among the registration criteria in Article 23 (1) is not met and any of the following items applies:
가. 「채무자 회생 및 파산에 관한 법률」에 따라 법원이 회생절차개시의 결정을 하고 그 절차가 진행 중인 경우
(a) Where a court has decided to commence rehabilitation procedures under the Debtor Rehabilitation and Bankruptcy Act and the procedures are in progress;
나. 「기업구조조정 촉진법」에 따라 금융채권자협의회에 의한 공동관리절차의 개시를 의결하고 그 절차가 진행 중인 경우
(b) Where commencement of joint management procedures has been resolved by the council of financial creditors under the Corporate Restructuring Promotion Act and the procedures are in progress.
