수산종자산업육성법 시행령 제19조(권한의 위임ㆍ위탁)
Enforcement Decree of the Act on Fostering the Aquatic Seed Industry, Article 19 (Delegation and entrustment of authority)
① 해양수산부장관은 법 제39조제1항에 따라 다음 각 호의 권한을 국립수산과학원장에게 위임한다. <개정 2023.10.10>
(1) Pursuant to Article 39 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the President of the National Institute of Fisheries Science:

3. 법 제28조제1항에 따른 수산식물종자 품종의 생산ㆍ수입 판매 신고의 수리
3. Acceptance of reports on production, import, and sale of aquatic plant seed varieties under Article 28 (1) of the Act;
4. 법 제28조제2항에 따른 주요 사항 변경 신고의 수리
4. Acceptance of reports on changes to major matters under Article 28 (2) of the Act;
5. 법 제29조에 따른 수산종자의 수출ㆍ수입 제한 또는 수입된 수산종자의 국내 유통 제한
5. Restrictions on export or import of aquatic seed or on domestic distribution of imported aquatic seed under Article 29 of the Act;
6. 법 제30조제1항에 따른 수입적격성심사의 실시
6. Conduct of import eligibility review under Article 30 (1) of the Act;
7. 법 제32조제1항에 따른 수산종자 등의 조사 또는 품질검사 및 수산종자 수거
7. Investigation or quality inspection of aquatic seed, etc. and collection of aquatic seed under Article 32 (1) of the Act;
8. 법 제32조제2항 전단에 따른 수산종자의 생산 또는 판매 중지 명령 및 수산종자 수거 명령
8. Orders to suspend production or sale of aquatic seed and orders to collect aquatic seed under the former part of Article 32 (2) of the Act;
9. 법 제33조에 따른 수산종자시료의 보관ㆍ관리
9. Storage and management of aquatic seed samples under Article 33 of the Act;
10. 법 제34조제1항에 따른 분쟁대상 수산종자에 대한 시험ㆍ분석 신청의 접수
10. Acceptance of applications for testing and analysis of aquatic seed in dispute under Article 34 (1) of the Act;
11. 법 제34조제3항에 따른 분쟁대상 수산종자의 시료채취 신청의 접수
11. Acceptance of applications for sampling of aquatic seed in dispute under Article 34 (3) of the Act;
12. 법 제34조제4항 전단에 따른 시료채취의 명령
12. Orders for sampling under the former part of Article 34 (4) of the Act;
13. 법 제34조제5항에 따른 시험ㆍ분석 결과의 통지
13. Notification of testing and analysis results under Article 34 (5) of the Act;
14. 법 제34조제6항에 따른 시험ㆍ분석에 필요한 자료의 제출 명령
14. Orders to submit data necessary for testing and analysis under Article 34 (6) of the Act;
15. 법 제35조제1항에 따른 분쟁조정 신청의 접수
15. Acceptance of applications for dispute mediation under Article 35 (1) of the Act;
16. 법 제37조제1항에 따른 수수료의 징수
16. Collection of fees under Article 37 (1) of the Act;
17. 법 제43조제1항제3호ㆍ제4호 및 같은 조 제2항제5호ㆍ제6호에 따른 과태료의 부과ㆍ징수
17. Imposition and collection of administrative fines under Article 43 (1) 3 and 4 and (2) 5 and 6 of the Act.
② 국립수산과학원장은 해양수산부장관의 승인을 받아 제1항에 따라 위임받은 권한의 일부를 소속 기관의 장에게 재위임할 수 있다.
(2) The President of the National Institute of Fisheries Science may, with the approval of the Minister of Oceans and Fisheries, re-delegate part of the authority delegated under paragraph (1) to the head of an institution under his or her jurisdiction.
③ 해양수산부장관은 법 제39조제1항에 따라 법 제43조제1항제1호ㆍ제2호 및 같은 조 제2항제1호부터 제4호까지의 규정에 따른 과태료의 부과 및 징수에 관한 권한을 시장ㆍ군수ㆍ구청장에게 위임한다. <개정 2023.10.10>
(3) Pursuant to Article 39 (1) of the Act, the Minister of Oceans and Fisheries delegates the authority concerning the imposition and collection of administrative fines under Article 43 (1) 1 and 2 and (2) 1 through 4 of the Act to the head of a Si/Gun/Gu.
④ 해양수산부장관은 법 제39조제2항에 따라 다음 각 호의 권한을 해양수산부령으로 정하는 수산업 관련 법인 또는 단체에 위탁한다. <신설 2023.10.10>
(4) Pursuant to Article 39 (2) of the Act, the Minister of Oceans and Fisheries entrusts the following authority to a fisheries-related corporation or organization prescribed by Ordinance of the Ministry of Oceans and Fisheries:
1. 법 제6조제1항에 따른 수산종자산업에 관한 통계 작성 및 실태조사
1. Preparation of statistics and surveys on actual conditions concerning the aquatic seed industry under Article 6 (1) of the Act;
2. 법 제6조제2항에 따른 자료 제출 요청(위탁된 권한을 수행하기 위하여 필요한 경우로 한정한다)
2. Requests for submission of data under Article 6 (2) of the Act (limited to where necessary for performing the entrusted authority).
