수산업협동조합법 제46조(임원의 정수 및 선출)

① 지구별수협에 임원으로 조합장을 포함한 7명 이상 11명 이하의 이사와 2명의 감사를 두되, 감사 중 1명은 대통령령으로 정하는 요건에 적합한 외부전문가 중에서 선출하여야 하며, 이사의 정수와 조합장의 상임이나 비상임 여부는 정관으로 정한다. 다만, 「수산업협동조합의 부실예방 및 구조개선에 관한 법률」 제9조에 따라 경영정상화 이행약정을 체결한 지구별수협이 2년 연속하여 그 경영정상화 이행약정을 이행하지 못한 경우에는 해당 지구별수협의 조합장은 비상임으로 한다. <개정 2015.2.3, 2018.12.11, 2020.2.18>

② 지구별수협은 제1항에 따른 이사 중 2명 이내의 상임이사를 두어야 하고, 상임이사 외에 조합원이 아닌 1명의 이사를 정관으로 정하는 바에 따라 둘 수 있으며, 감사 중 1명을 상임으로 할 수 있다. 다만, 자산 규모가 해양수산부령으로 정하는 기준에 미달하거나 신용사업을 수행하지 아니하는 경우에는 상임이사를 두지 아니할 수 있다. <개정 2013.3.23>

③ 조합장은 조합원(법인인 경우에는 그 대표자를 말한다) 중에서 정관으로 정하는 바에 따라 다음 각 호의 어느 하나의 방법으로 선출한다.

④ 조합장 외의 임원은 총회에서 선출한다. 다만, 상임이사와 상임이사 외의 조합원이 아닌 이사는 조합 업무에 관한 전문지식과 경험이 풍부한 사람으로서 대통령령으로 정하는 요건을 충족하는 사람 중에서 인사추천위원회에서 추천한 사람을 총회에서 선출한다. <개정 2016.5.29>

⑤ 조합장(상임인 경우에만 해당한다), 상임이사 및 상임감사를 제외한 지구별수협의 임원은 명예직으로 하되, 정관으로 정하는 바에 따라 실비변상(實費辨償)을 받을 수 있다.

⑥ 지구별수협의 조합장선거에 입후보하기 위하여 임기 중 그 직을 그만둔 지구별수협의 이사 또는 감사는 그 사직으로 인하여 공석이 된 이사 또는 감사의 보궐선거의 후보자가 될 수 없다. <신설 2012.2.17>

⑦ 임원의 선출과 추천, 제4항에 따른 인사추천위원회 구성과 운영에 관하여 이 법에서 정한 사항 외에 필요한 사항은 정관으로 정한다. <개정 2012.2.17>

⑧ 지구별수협은 이사 정수의 5분의 1 이상을 여성조합원에게 배분되도록 노력하여야 한다. 다만, 여성조합원이 전체 조합원의 100분의 20 이상인 지구별수협은 이사 중 1명 이상을 여성조합원 중에서 선출하여야 한다. <개정 2012.2.17, 2014.3.18, 2025.9.16>

⑨ 제1항의 감사 선출에서 조합이 도서지역에 있거나 영세하여 부득이하게 외부전문가 감사를 선출할 수 없는 경우 등 대통령령으로 정하는 경우에는 중앙회에서 외부전문가인 감사를 파견하거나 감사 선출과 관련한 재정적 지원을 할 수 있다. <신설 2015.2.3, 2020.3.24>
