Fisheries Cooperatives Act, Article 172 (Management Guidance)

① 해양수산부장관은 조합등이 다음 각 호의 어느 하나의 경우에 해당되어 조합원 보호에 지장을 줄 우려가 있다고 인정하면 해당 조합등에 대하여 경영지도를 한다. <개정 2013.3.23, 2016.5.29, 2020.3.24>

1. 조합에 대한 감사 결과 조합의 부실대출을 합친 금액이 제68조에 따른 자기자본의 2배를 초과하는 경우로서 단기간 내에 일반적인 방법으로는 회수하기가 곤란하여 자기자본의 전부가 잠식될 우려가 있다고 인정되는 경우

③ 해양수산부장관은 제1항에 따른 경영지도가 시작된 경우에는 6개월 이내의 범위에서 채무의 지급을 정지하거나 임원의 직무를 정지할 수 있다. 이 경우 중앙회의 회장에게 지체 없이 조합등의 재산상황을 조사(이하 이 조에서 "재산실사"라 한다)하게 하거나 금융감독원장에게 재산실사를 요청할 수 있다. <개정 2013.3.23, 2016.5.29>

④ 중앙회의 회장 또는 금융감독원장은 제3항 후단에 따른 재산실사 결과 위법ㆍ부당한 행위로 인하여 조합등에 손실을 끼친 임직원에 대하여는 재산 조회 및 가압류 신청 등 손실금 보전을 위하여 필요한 조치를 하여야 한다. <개정 2016.5.29>

⑥ 해양수산부장관은 재산실사 결과 해당 조합등의 경영정상화가 가능한 경우 등 특별한 사유가 있다고 인정되면 제3항 전단에 따른 채무 지급정지 또는 직무정지의 전부 또는 일부를 철회하여야 한다. <개정 2013.3.23, 2016.5.29>

⑧ 중앙회의 회장 또는 사업전담대표이사는 정관으로 정하는 바에 따라 경영적자ㆍ자본잠식 등으로 인하여 경영 상태가 부실한 조합에 대한 자금 결제 및 지급 보증의 제한이나 중지, 수표 발행 한도의 설정 또는 신규수표의 발행 중지, 2년 이상 연속 적자조합에 대한 정책자금의 취급 제한 또는 중지, 금융사고가 발생한 조합에 대한 예금 대지급(代支給) 중단 등 자산 건전성 제고를 위하여 필요한 조치를 할 수 있다.
