수산업법 제13조(면허의 우선순위)

1. 대통령령으로 정하는 수산기술자(이하 "수산기술자"라 한다)로서 그 신청한 어업과 같은 종류의 어업을 경영하였거나 이에 종사한 자 또는 그 신청일 이전 5년 동안(「어장관리법」에 따른 어장휴식 기간은 제외한다) 그 신청한 어업과 같은 종류의 어업을 경영하였거나 이에 종사한 자

2. 수산기술자로서 제40조제2항에 해당하는 어업을 경영하였거나 이에 종사한 자 또는 그 신청일 이전 5년 동안(「어장관리법」에 따른 어장휴식 기간은 제외한다) 같은 항에 해당하는 어업을 경영하였거나 이에 종사한 자

1. 해당 어업의 어장에서 이 법, 「어장관리법」, 「양식산업발전법」 또는 「수산자원관리법」을 위반하거나 이 법, 「어장관리법」, 「양식산업발전법」 또는 「수산자원관리법」에 따른 명령ㆍ처분 또는 그 제한이나 조건을 위반하여 행정처분을 받은 자

2. 해당 어업의 어장에서 어장관리 및 어업경영상태가 매우 부실하다고 인정되는 자

3. 해당 어업권을 취득하였다가 정당한 사유 없이 양도한 자

4. 제88조제1항제1호에 해당하는 사유로 어업권이 취소되어 손실보상을 받은 자. 다만, 손실보상 당시 다른 어업권을 이미 취득하였거나 보상받은 뒤 제19조제1항 각 호의 어느 하나에 따라 어업권을 이전ㆍ분할 받은 경우 각 어업권의 유효기간이 끝나 새로 어업면허를 신청하는 때에는 우선순위에서 제외할 수 없다.
