수산업ㆍ어촌 발전 기본법 시행령 제26조(보조금의 지급 절차)

① 법 제49조제3항에 따라 보조금을 받으려는 자는 해당 사업의 목적과 내용, 사업에 필요한 경비 등을 명확히 하여 해양수산부장관에게 보조금의 지급을 신청하여야 한다.

② 해양수산부장관은 제1항에 따른 신청을 받으면 다음 각 호의 사항을 조사하여 보조금 지급 여부를 결정하고 그 결과를 보조금 신청인에게 통지하여야 한다.

③ 해양수산부장관은 보조금 지급을 결정할 때에는 보조 대상 사업이 완료되고 보조금을 받은 자에게 상당한 수익이 발생할 경우에는 그 보조금의 지급 목적에 위배되지 아니하는 범위에서 이미 지급한 보조금의 전부 또는 일부를 기금에 반환하도록 하는 등 법령과 기금에서 정하는 보조금의 지급 목적을 달성하는 데에 필요한 조건을 붙일 수 있다.
