소상공인기본법 제9조(실태조사 및 통계작성)

① 중소벤처기업부장관은 소상공인 보호 ㆍ육성에 필요한 시책을 효율적으로 수립ㆍ시행하기 위하여 매년 소상공인의 현황 및 경영실태 등에 관한 실태조사를 실시하고 그 결과를 공표하여야 한다.

② 중소벤처기업부장관은 제1항에 따른 실태조사 등을 참고하여 소상공인에 관한 통계를 작성ㆍ관리하고 공표하여야 하며, 필요한 경우 국가데이터처장과 협의할 수 있다. <개정 2025.10.1>

③ 중소벤처기업부장관은 제1항에 따른 실태조사 및 제2항에 따른 통계의 작성ㆍ관리를 위하여 필요한 때에는 관계 중앙행정기관의 장, 시ㆍ도지사, 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관의 장, 소상공인 또는 소상공인 관련 단체에 자료 또는 의견 제출을 요청할 수 있다. 이 경우 요청을 받은 자는 특별한 사유가 없으면 그 요청에 따라야 한다.

④ 중소벤처기업부장관은 제1항에 따른 실태조사 및 제2항에 따른 통계의 작성ㆍ관리 업무를 제32조에 따른 전문연구평가기관 또는 「소상공인 보호 및 지원에 관한 법률」 제17조에 따른 소상공인시장진흥공단에 위탁할 수 있다.

⑤ 그 밖에 제1항에 따른 실태조사와 제2항에 따른 통계 작성ㆍ관리의 방법 및 절차 등에 관하여 필요한 사항은 대통령령으로 정한다.
